子どもの権利条約を読む 第1条～第4条

子どもの権利条約は、１９８９年１１月２０日、国連総会で満場一致で制定されました。

子どもの権利(人権）を明らかにし、その子どもの権利を守ることを謳っています。

日本は１９９４年に子どもの権利条約を国会の承認を得て批准し、世界の国々に対し、日本も子どもの権利条約に書かれたことを実行すると約束しました。

●第1条　子どもの定義

18歳になっていない人を子どもとします。

この条約の適用上、児童とは、18歳未満のすべての者をいう。ただし、当該児童で、その者に適用される法律によりより早く成年に達したものを除く。

PART I 

Article 1

For the purposes of the present Convention, a child means every human being below the age of eighteen years unless under the law applicable to the child, majority is attained earlier.

 

●第2条　差別の禁止

すべての子どもは、みんな平等にこの条約にある権利をもっています。子どもは、国のちがいや、性のちがい、どのようなことばを使うか、どんな宗教を信じているか、どんな意見をもっているか、心やからだに障がいがあるかないか、お金持ちであるかないか、親がどういう人であるか、などによって差別されません。

1. 締約国は、その管轄の下にある児童に対し、児童又はその父母若しくは法定保護者の人種、皮膚の色、性、言語、宗教、政治的意見その他の意見、国民的、種族的若しくは社会的出身、財産、心身障害、出生又は他の地位にかかわらず、いかなる差別もなしにこの条約に定める権利を尊重し、及び確保する。
2. 締約国は、児童がその父母、法定保護者又は家族の構成員の地位、活動、表明した意見又は信念によるあらゆる形態の差別又は処罰から保護されることを確保するためのすべての適当な措置をとる。

Article 2 

1. States Parties shall respect and ensure the rights set forth in the present Convention to each child within their jurisdiction without discrimination of any kind, irrespective of the child’s or his or her parent’s or legal guardian’s race, colour, sex, language, religion, political or other opinion, national, ethnic or social origin, property, disability, birth or other status. 

2. States Parties shall take all appropriate measures to ensure that the child is protected against all forms of discrimination or punishment on the basis of the status, activities, expressed opinions, or beliefs of the child’s parents, legal guardians, or family members.

1. 児童に関するすべての措置をとるに当たっては、公的若しくは私的な社会福祉施設、裁判所、行政当局又は立法機関のいずれによって行われるものであっても、児童の最善の利益が主として考慮されるものとする。
2. 締約国は、児童の父母、法定保護者又は児童について法的に責任を有する他の者の権利及び義務を考慮に入れて、児童の福祉に必要な保護及び養護を確保することを約束し、このため、すべての適当な立法上及び行政上の措置をとる。
3. 締約国は、児童の養護又は保護のための施設、役務の提供及び設備が、特に安全及び健康の分野に関し並びにこれらの職員の数及び適格性並びに適正な監督に関し権限のある当局の設定した基準に適合することを確保する。

Article 3

1. In all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration.

2. States Parties undertake to ensure the child such protection and care as is necessary for his or her well-being, taking into account the rights and duties of his or her parents, legal guardians, or other individuals legally responsible for him or her, and, to this end, shall take all appropriate legislative and administrative measures. 

3. States Parties shall ensure that the institutions, services and facilities responsible for the care or protection of children shall conform with the standards established by competent authorities, particularly in the areas of safety, health, in the number and suitability of their staff, as well as competent supervision.

●第4条　国の義務

国は、この条約に書かれた権利を守るために、必要な法律を作ったり政策を実行したりしなければなりません。

締約国は、この条約において認められる権利の実現のため、すべての適当な立法措置、行政措置その他の措置を講ずる。締約国は、経済的、社会的及び文化的権利に関しては、自国における利用可能な手段の最大限の範囲内で、また、必要な場合には国際協力の枠内で、これらの措置を講ずる。

Article 4

States Parties shall undertake all appropriate legislative, administrative, and other measures for the implementation of the rights recognized in the present Convention. With regard to economic, social and cultural rights, States Parties shall undertake such measures to the maximum extent of their available resources and, where needed, within the framework of international co-operation.
