気に入りのブログ Recipe Tin Eats の NagiことNagi Maehashi さんがオーストリアのペンギンランダムハウスに抗議をしたとInstagramで知りました。
同社で出版された『Bake with Brooki』(by Brooke Bellamy)の内容の一部がNagi のレシピに酷似している、との事。
Nagi はペンギンランダムハウス(のリーガルティーム)からの返信に納得がいかず弁護士を立てました。
似ているのはこの２つのレシピ↓↓↓
『カラメルスライス』
『バクラヴァ』
“To me, the similarities between the recipes in question are far too specific and detailed to be dismissed as coincidence,”
この二つのレシピは偶然として片付けるにはあまりに似すぎている。
これまたワタクシがフォローしている『Sally’s Baking Addiction』の Sally McKenney も「The Best Vanilla Cake I’ve Ever Had, published by me in 2019」に酷似したレシピがその本に載っている、と表明しています。
Brook Bellamy は
“I do not copy other people’s recipes. Like many bakers, I draw inspiration from the classics, but the creations you see at Brooki Bakehouse reflect my own experience, taste, and passion for baking, born of countless hours of my childhood spent in my home kitchen with Mum,”
“While baking has leeway for creativity, much of it is a precise science and is necessarily formulaic. Many recipes are bound to share common steps and measures: if they don’t, they simply don’t work,”
と剽窃を否定しています。
好きな人はいないと思いますが、ワタクシ剽窃が大嫌いです。
レシピの剽窃を証明するのは困難と言われています。
が、上の２つのレシピについてはNagiが剽窃だと言うのも無理ないと思います。
Brookの主張もある程度わかる気がする。
本当は5g程度の差があっても、作りやすいように、公表するレシピでは丸めちゃうこともあるだろうし、
一方で比率があまりに違うと期待した効果が出ないから、どうしても似通ってしまう傾向にはあると思う。
サイエンスと言われればそうかもしれない。
ベーキングに使う器のサイズもほぼ同じだろうから、さらに酷似しますよね。
それに、読み手が慣れた言い回しにすると、さらに表現でも似通う方向に振れちゃう。

の中でNagi も
『Maehashi acknowledged that the law around plagiarism and online content makes it hard to challenge legally.
“Copyright law protects creative expression, not facts or functional instructions. So while you can’t copyright the idea of ‘a caramel slice made without golden syrup in the filling’ copyright can protect the way a recipe is written,” she wrote.』
と言っています。
ベイキングはサイエンス，その通りだと思います。 分量と作り方が似るのは避けられないんじゃないか？とも思います。
となると、作り方の説明を自分の言葉でする，というところにかかるのかしら？
Nagi も Brook もすごいストレスだろうな。
多分ね、今までレシピのこんな言葉使ったの見たことない！とか。
でもそれがもしも料理を作りたいひとがレシピ本に期待する表現を逸脱してたら、本末転倒かもね〜

これね、ありました！ Facebook で流れてきたんですが、笑っちゃう単語選びでした。でもちゃんとレシピになってました、興味ある料理ではなかったので作ってみなかったけど。アレなら剽窃訴えられる事は絶対ないわぁ😅
