国連人権理事会特別報告者アナンド・グローバー(インド人弁護士)が11月15日~26日まで来日した。
政府関係者、医療従事者などへの調査を終え、
東日本大震災後、被災者などに対して"健康を享受する権利"が機能していたかどうかについて中間報告を発表し、
記者の質問に答えた。

達成可能な最高水準の心身の健康を享受する権利短く言うと「健康を享受する権利」に関する
国連人事理事会特別報告者としての
ミッションを説明した簡単な資料をこの会場に用意しております。
端的に申しますと、
私は健康を享受する権利の実現に関して国連人事理事会及び国連総会に報告・勧告をする独立専門家です。
国連人権理事会から任命を受けましたが、
国連に雇われているわけではなく、名誉職という立場で今回の任務を遂行しています。
独立専門家として、私なりの結論と提言をまとめるべく、専門的判断を下します。
本日の発表は、予備的考察の一部に限らせていただきます。
詳細につきましては2013年6月に国連人権理事会に提示する最終報告で発表いたします。
ー略ー
原発事故の直後には、
放射性ヨウ素の取り込みを防止して甲状腺がんのリスクを低減するために、
被ばくした近隣住民の方々に安定ヨウ素剤を配布する、というのが常套手段です。
私は、日本政府が被害に遭われた住民の方々に安定ヨウ素剤に関する指示を出さず、
配布もしなかったことを残念に思います。
にもかかわらず、一部の市町村は独自にケースバイケースで安定ヨウ素剤を配布しました。
災害、なかでも原発事故のような人災が発生した場合、政府の信頼性が問われます。
従って、日本政府が正確な情報を提供して、住民を汚染地域から避難させることが極めて重要です。
しかし、残念ながらSPEEDIによる放射線量の情報、
および放射性プルームの動きが直ちに公表されることはありませんでした。
さらに避難対象区域は、実際の放射線量ではなく、
災害現場からの距離および放射性プルームの到着範囲にもとづいて設定されました。
従って、当初の避難区域はホットスポットを無視したものでした。
これに加えて、日本政府は避難区域の指定に年間20ミリシーベルトという基準値を使用しました。
これは、年間20ミリシーベルトまでの実行線量は安全であるという形で伝えられました。
また、学校で配布された副読本などのさまざまな政府刊行物において、
「年間100ミリシーベルト以下の放射線被ばくが、
癌に直接的につながるリスクがあることを示す明確な証拠はない」と発表することで
状況はさらに悪化したのです。
年間20ミリシーベルトという基準値は、
1972年に定められた原子力業界安全規制の数字と大きな差があります。
原子力発電所の作業従事者の被ばく限度、管理区域内では
「年間20ミリシーベルト、年間50ミリシーベルトを超えてはならないと定められていまして、
5年間で累計100ミリシーベルト」と、法律に定められています。
3カ月間で放射線量が1.3ミリシーベルトに達する管理区域への一般市民の立ち入りは禁じられており、
作業員は当該地域での飲食、睡眠も禁止されています。
また、被ばく値が年間2ミリシーベルトを超える管理区域への妊婦の立ち入りも禁じられています。
ここで思い出していただきたいのは、
チェルノブイリ事故のあった際、強制移住の基準値は土壌汚染レベルとは別に、
年間5ミリシーベルト以上であったという点です。
また、多くの疫学研究において、
年間100ミリシーベルトを下回る低線量放射線でも、
癌、その他の疾患が発生する可能性があるという指摘がなされています。
研究によれば疾患の発症に下限となる放射線基準値はないのです。
残念ながら、政府が政策で定めた現行の限界線量と、国内の業界安全規制で定められた限界線量、
チェルノブ位置事故時に持ちいられた放射線量の限界値、
そして、疫学研究の知見との間には一貫性がありません。
これが多くの地元住民の間に混乱を招き、
政府発表のデータや方針に対する疑念が高まることに繋がっているのです。
これに輪をかけて、放射線モニタリングステーションが、
監視区域に近接する区域のさまざまな放射線量レベルを反映していないという事実が挙げられます。
その結果、地元住民の方々は、自分たちの放射線量をモニタリングするために
近隣地域の放射線量のモニタリングを自ら行っているという状況にあります。
訪問中、私はそうした際を示す多くのデータを見せてもらいました。
こうした状況において、私は日本政府に対して
住民が測定したものも含め、すべての有効な独立データを取り入れ公にする事を要請いたします。
健康を享受する権利に照らして、
日本政府は全体的かつ包括的なスクリーニングを通じて、
放射線汚染区域における放射線による健康への影響をモニタリングし、適切な処置を取るべきです。
この点に関しては、日本政府はすでに健康管理調査を実施しています。
これは良いのですが、
同調査の対象は、福島県民の呼び被害災害発生時に福島県を訪れていた人々に限られています。
そこで私は日本政府に対して、健康調査を放射線汚染地域全体において実施することを要請しいたます。
これに関連して、福島県の健康管理調査の質問回答率は僅か23%余りと、大変低い数値でした。
また、健康管理調査は
子どもを対象とした甲状腺検査、全体的な健康診査、メンタル面や生活習慣に関する調査、
妊産婦に関する調査に限られています。
残念ながら、調査範囲が狭いのです。
これは、チェルノブイリ事故から限られた教訓しか活用しておらず、
また、低線量放射線地域、たとえば年間100ミリシーベルトを下回る地域でさえも、
癌その他の疾患の可能性があることを指摘する疫学研究を無視しているためです。
健康を享受する権利の枠組みにしたがい、日本政府に対して慎重に慎重を重ねた対応を取ること、
また、包括的な調査を実施し、長時間かけて内部被ばくの調査とモニタリングを行うよう推奨いたします。
自分の子どもが甲状腺検査を受け、
基準値を下回る程度の大きさののう胞や結節の疑いがあるという診断を受けた住民からの報告に、
私は懸念を抱いています。
検査後、ご両親は二次検査を受ける事も出来ず、、要求しても診断書も受け取れませんでした。
事実上、自分たちの医療記録にアクセスする権利を否定されたのです。
残念なことにこれらの文書を入手するためには、煩雑な情報公開請求の手続きが必要なのです。
政府は原子力発電所作業員の放射線による影響のモニタリングについても、特に注意を払う必要があります。
一部の作業員は、極めて高濃度の放射線に被曝していました。
何重もの下請け会社を介在して、大量の派遣作業員を雇用しているという事を知り心が痛みました。
その多くが短期雇用で、雇用契約終了後に長期的な健康モニタリングが行われることはありません。
日本政府に対してこの点に目をそむけることなく、
放射線に被ばくした作業員全員に対してモニタリングや治療を施すよう要請いたします。

日本政府は避難者の方々に対して、一時避難施設あるいは補助金支給住宅施設を用意しています。
これは良いのですが、住民の方々によれば、
緊急避難センターは障害者向けにバリアフリー環境が整っておらず、
また、女性や小さな子どもが利用することに配慮したものでもありませんでした。
悲しい事に、原発事故発生後に住民の方々が避難した際、家族が別々にならなければならず、
夫と妻、夫と母と子ども、およびお年寄りが離れ離れになってしまう事態に繋がりました。
これが、互いの不調和、不和を招き、離婚に至るケースすらありました。
苦しみや精神面での不安につながったのです。
日本政府はこれらの重要な課題を早急に解決しなければなりません。
食品の放射線汚染は長期的な問題です。
日本政府が食品安全基準値を
1kgあたり500ベクレルから100ベクレルに引き下げたことは称賛に値します。
しかし、各県ではこれよりも低い水準値を設定しております。
さらに住民はこの基準の導入について不安を募らせています。
日本政府は早急に食品安全の施行を強化すべきです。
また、日本政府は土壌汚染への対応を進めています。
長期的目標として、汚染レベルが
年間20ミリシーベルト未満の地域の放射線レベルは1ミリシーベルトまで引き下げる。
また、年間20~50ミリシーベルトの地域については
2013年末までに年間20ミリシーベルト未満に引き下げる、という具体的政策目標を掲げています。
ただ、ここでも残念なのは、現在の放射線レベルが
年間20ミリシーベルト未満の地域で年間1ミリシーベルトまで引き下げるという目標について、
具体的なスケジュールが決まっていないという点です。
さらに、他の地域については、汚染除去レベル目標は
年間1ミリシーベルトを大きく上回る数値に設定されています。
住民は、安全で健康的な環境で暮らす権利があります。
したがって、日本政府に対して他の地域について、
放射線レベルを年間1ミリシーベルトに引き下げる明確なスケジュール、指標、
ベンチマークを定めた汚染除去活動計画を導入することを要請いたします。
汚染除去の実施に際しては、
専用の作業員を雇用し、作業員の手で実施される予定であるということを知り、
結構なことであると思いました。
しかし、一部の汚染除去作業が、住民自身の手で、
しかも適切な設備や放射線被ばくに伴う悪影響に関する情報もなく行われているのは残念なことです。
また日本政府は、全ての避難者に対して経済的支援や補助金を継続、または復活させ、
避難するのかそれとも自宅に戻るのか、どちらを希望するか、
避難者が自分の意思で判断できるようにするべきです。
これは日本政府の計画に対する避難者の信頼構築にもつながります。
訪問中多くの人々が、
東京電力は原発事故の責任に対する説明義務を果たしていないことへの懸念を表明されました。
日本政府が東京電力の株の大多数を所有していること、
これは突き詰めれば納税者がつけを払わされる可能性があるという事でもあります。
健康を享受する権利の枠組みに於いては、
訴訟にもつながる謝った行為に関わる責任者の説明責任を定めています。
従って日本政府は、東京電力も説明責任があることを明確にし、
納税者が最終的な責任を負わされることのないようにしなければなりません。
ご臨席の皆様、また記者のみなさん、
訪問中、被害にあわれた住民の方々、特に障害者、若い母親、妊婦、子ども、お年寄りなどの方々から、
「自分たちに影響が及ぶ決定に対して発言権がない」という言葉を耳にしました。
健康を享受する権利の枠組みに於いては、地域に影響が及ぶ決定に際して、
そうした影響が及ぶ全ての地域が決定プロセスに参加するよう国に求めています。
つまり、今回被害に遭われた人々は
意思決定プロセス、さらには実行、モニタリング、説明責任プロセスにも参加する必要があるという事です。
こうした参加を通じて、
決定事項が全体に伝わるだけではなく、被害に遭った地域の政府に対する信頼強化にもつながるのです。
これは、効率的に災害からの復興を成し遂げるためにも必要であると思われます。
日本政府に対して、被害に遭われた人々、特に社会的弱者を
全ての意思決定プロセスに十分に参加してもらうよう要請いたします。
こうしたプロセスには、
健康管理調査の策定、避難所の設計、汚染除去の実施等に関する参加などがあげられるでありましょう。
この点については、
「東京電力原子力事故により被災した子どもをはじめとする住民等の生活を守り支えるための被災者の生活支援等に関する施策の推進に関する法律」が
2012年6月に制定されたことを歓迎します。
この法律は原子力事故により影響を受けた人々の支援及びケアに関する枠組みを定めたものです。
この法律はまだ施行されておらず、
私は日本政府に対して同法を早急に施行する方策を講じることを要請いたします。
これは日本政府にとって、社会的弱者を含む被害を受けた地域が十分に参加する形で、
基本方針や関連規制の枠組みを定めるよい機会になることであるとおもいます。
