Data from signatory countries show that the majority of abductors are mothers with primary or joint custody, and a majority of them report fleeing abuse. In short, many abductions are actually flights to safety, necessitated by the home countries’ failure to protect victims from domestic violence and child abuse. In these cases, rather than returning children to loving and safe parents, the convention actually reunifies children and mothers with their abusers.

Research by Jeffrey Edleson, the dean of the School of Social Welfare at the University of California, Berkeley, and his colleagues shows that courts typically order children returned to fathers known to have physically abused the mother, even though such violence is an indicator of significant risk to children.

While Mr. Edleson’s research found that some courts did not order a return when direct child abuse was absolutely proved, in other cases courts have been unwilling to sort through abuse allegations of any kind, preferring to send such cases, and the reported victims, back to the country they fled for resolution.

Lost in the calls for blanket returns of “abducted” children is the fact that the convention itself prioritizes children’s best interests, and therefore does not require return in every case. Return is not required when the left-behind parent does not have a “right of custody,” where there is grave psychological or physical risk to the child, or where the child will be returned to an “intolerable situation.”

But too often, the convention’s nuanced awareness of the potential harms of returns has been ignored by courts and the legislative and diplomatic supporters of return at all costs. In one widely reported case, a California court sent the son of an American mother back to his European father despite acknowledging that he faced a “grave risk” of harm. (The child continues to suffer overseas.)



The federal government should recognize that many abductions are actually means of keeping children safe.

 いずれにせよ、日本の裁判所で、DVが認められて、返還しない場合、かならず、CNNやNYT、あるいは主要なテレビ局によるアメリカ愛国主義的な日本バッシングがあるだろうが、そのときでも、この記事は参考になろう。



White House: Secret spying on Americans immune to lawsuits

After the US Supreme Court upheld the right of the National Security Agency to wiretap Americans’ communications with foreigners without a warrant, the White House seeks to quash a similar lawsuit citing the plaintiff’s inability to provide evidence.

Last week the justices ruled 5-4 against the American Civil Liberties Union and others who sought to nullify a provision of the Foreign Intelligence Surveillance Act, or FISA. The provision allows the National Security Agency (NSA) to intercept emails and phone calls of Americans as long as they are suspected of communicating with someone outside of the country.

Judges ruled that the ACLU et al were not eligible to complain because they could not submit evidence that they were targeted by the surveillance program.

Now the White House is seeking to quash another case against the same NSA eavesdropping program, citing the previous ruling as a precedent, reports Wired.

The lawsuit filed by the Electronic Frontier Foundation accuses the US government of secretly monitoring all of Americans’ electronic communications with the assistance of nation’s telecom companies. The EFF says this violates the Fourth Amendment, which protects US citizens from unreasonable searches.

A filing the government submitted on Wednesday it says the previous Supreme Court ruling reaffirms that “a plaintiff bears the burden of establishing standing through the submission of actual evidence, not speculation about present or future injuries. In this case, any such evidence is properly protected by the Government’s state secrets privilege assertion.”

Real Estate Locusts: Developers Cash in on Europe's Poorest

In recent years, international investors have poured billions into Berlin to buy cheap real estate, including buildings in need of much repair and lacking modern amenities. Such a building can be found in the back courtyard of Scharnweberstrasse 111 in Reinickendorf, a northwestern district of Berlin.


Narghita, a member of the Roma ethnic group from Romania, lives in one of the building's apartments: a one-room unit of 33 square meters (255 square feet) for €705 ($915) a month, excluding heat. The toilet hasn't worked for weeks, and her three children urinate in the bathtub. She found her furniture in the garbage and has poisoned the rats in the apartment.

Narghita has always paid her rent in cash to Marcus Harstel, who until recently managed some apartments for the owners. He chairs an association that brokers run-down property owned by international investors to the poor and disadvantaged: ex-convicts, the homeless and immigrants, particularly Roma and Sinti. The conditions on some of the floors at Scharnweberstrasse 111 are like those in a refugee camp, with multiple parties sharing the few intact bathrooms.


In reality, however, Harstel was providing real estate speculators with undemanding tenants, who live in squalid conditions under the threat of violence and eviction and have few places to turn for help. This ruthless business model is widespread in Berlin, one of many cities in Europe where poor immigrants go.

Immigrants would have to put up a cash bond to enter Britain under radical reforms to be unveiled by Theresa May.
They will be required to pay the ‘entry fee’ as part of a guarantee that they will not be a burden on taxpayers and will leave when their visa expires.
The cash would be repaid when migrants leave, but only if they demonstrate that they have not drawn on services, such as non-urgent NHS care or other elements of the welfare state.

欧米では、反ゲイ犯罪、虐めが極端になる場合が多く、その反面、それゆえ、反ー反ゲイ法、ゲイの権利が社会的に認知されやすいのだろう、というのが私見。

もっとも、この世界の潮流からして、日本でももっと問題にすべき。世界で問題があるから、というより、日本でも差別的な意識や制度があり、問題があるから。







Part Three: Responding to the Insult


1Ask them what they want. Sometimes, simply asking the other person, "Are you trying to hurt me?" is enough to make them back down.
2Change the subject. For example, if the person insults your dress sense, you could respond with a nonchalant, "Yes, that's true and maybe you can tell me where you shop for your clothes?" This will derail the other person's train of thought.
3Agree with them in a joking way. When a person accuses you of being fat, you might respond with, "Are you joking? I'm a whale!" When a person accuses you of being stupid, you might say, "You can do better than that--I'm so dumb it took me 2 hours to watch 60 Minutes!" Remember that this person is hoping to make you feel bad and by showing them that you don't care, you leave them powerless.

う)の冗談で応じるというのは面白い。

可笑しさ、とは、1)規範・期待違反行為 2)と同時に 3)(1)を許容 という三つの契機によりなっているから、馬鹿にするという行為(1)を受け止める(3)ことによって、かえって、1)の行為を価値低下させる機能があるわけですね。
