Italian town offers 2,000 euros to immigrants who will leave
An Italian town has proposed giving jobless immigrants a one-off 2,000 euro payment as long as they agree to live elsewhere.

The town council is controlled by the xenophobic Northern League, which has previously called on the Italian navy to sink boats trying to smuggle in illegal immigrants from North Africa

The Northern League's leaders have welcomed the idea and have suggested extending it to other towns.

The party – La Lega Nord in Italian - wants greater autonomy for the wealthy regions of Italy's north, including the Veneto.

I came back this evening after I ran into Professor Lee In-ho, former Korean ambassador to Finland and Russia and lecturer, who’s lecture “Rewriting Korean History” explained just how South Korea’s flawed political and educational systems have led to the anti-Americanism in South Korea and the glorification of the North Korean state by South Korean teachers and students.

Dr. Lee, however, stated tonight that she now realizes that the situation is much worse than she originally described in her lecture and, sure enough, when I come home and look at the Joongang-Ilbo, one sees the KTEWU (Korea Teachers and Educational Workers Union) at work again, protesting lectures given at Seoul High Schools because their version of Korean history is not presented.

Naturally, the KTEWU mentioned the Japanese as a pretext for protesting.

　もちろん、日本を口実にして抗議した、という。

NEW YORK (AP) -- A federal judge has ruled that ethnicity is not a valid factor in making an arrest, handing a victory to two Egyptian-born men who sued the government after they were detained at New York's Kennedy Airport.

Two agents with a terrorism task force who also were aboard claimed they became suspicious after Farag, a retired New York City police officer, and Elmasry, a General Electric sales manager, switched seats and spoke in Arabic.
Elmasry caused more concern by repeatedly checking his watch and, in a conversation with one of the agents, revealing he was from Egypt, court papers said.
The agents had the pilot alert authorities at Kennedy that they suspected two Arab passengers were conducting surveillance. As they left the plane, the men were greeted by a team of police officers, handcuffed and thrown in jail cells before being released hours later.

　昨日紹介した本なんかでも資本主義について歴史や様々な形態や、問題点をわりにわかりやすくあげていた。
　今回の危機も規模は大きかったものの全然予測出来なかったわけではない。なんぜ、儲けを期待して投資する機構が相互連関して社会を動かしている資本主義では、バブルとバブル崩壊はつねにつきまとっているのだから。とはいえ、国家統制による従来型の共産主義の道はない。

　おもしろいが、まあ、経済音痴のおいらが何言ってもハズレだろうから、特に書くこともないが、しかし、記述の中で、日本が戦争に突入していく経済的背景みたいのが英語で書いてあるから、引用しておく。日本語ではよくお目にかかるが、英語での説明には多少役にたつかもしれない。

中国籍の女性殺害、夫と交際の２３歳・中国籍女逮捕

　１日午前４時半頃、名古屋市中区新栄のマンション「向陽ビル」２０３号室で、この部屋に住む中国籍のアルバイト店員黄彬影さん（４１）が手足をひもで縛られた状態で死亡しているのを、通報で駆け付けた愛知県警中署員が見つけた。

　黄さんの左脇腹に刺し傷があったことから、同署は殺人事件と断定。黄さんの知人で、中国籍の同市北区、無職徐興華容疑者（２３）が犯行を認めたため、殺人容疑で逮捕した。

　発表によると、徐容疑者は１０月３１日午後７時頃、同室で、黄さんの夫（４２）との交際を巡って口論となった末、黄さんの胸や腹などをナイフで数回刺すなどして殺害した疑い。犯行に使われたナイフはマンション近くの路上で見つかった。

　徐容疑者は調べに対し、「交際について、黄さんから我慢できないことを言われた。ナイフは持ってきた」などと供述しているという。

A pregnant Chinese woman registered a bogus marriage with a Japanese man to gain Japanese nationality for the baby and to continue working here, Tokyo police said.

After the "marriage," the woman continued living with the baby's biological father, a Chinese man suspected of violating the immigration control law, while the Japanese "husband" received 540,000 yen ($5,725) as a reward, police said.

The baby was born in Japan in November 2006, two months after the marriage. He lived with his biological parents before being sent to stay with his mother's relatives in China's Shandong province in April this year.

The Metropolitan Police Department suspects many children are living in China who acquired Japanese citizenship through similar methods.

"These women leave their child with their relatives in China and continue to earn money in Japan," a senior MPD official said. "They later get their child back in Japan, cancel their bogus marriage and remarry the real father of the child."

Both the Chinese woman, Jiang Xinxin, 27, and the Japanese man, 47, have been indicted on charges of recording false information in official documents.

According to police, Jiang came to Japan in October 2001 and attended a private university in Chiba Prefecture.

In September 2006, she registered her marriage with the Japanese man in Okaya, Nagano Prefecture.

The boy was given a Japanese name and registered in the Okaya man's family registration as his child.

However, the baby's real father is Chen Zhui, 33, a suspected illegal labor broker who is now on trial in a separate case.

Jiang continued working at a duty-free shop in Tokyo's Akihabara district while attending the university.

"The fake marriage was arranged so that I could work in Japan for a long time," police quoted Jiang as saying.

About six months after the boy's birth, Jiang and the Japanese man "divorced."

He has admitted to being paid to marry Jiang by a bridal company in Nagano Prefecture.

"Jiang was pregnant when I met her for the first time," police quoted the Okaya man as saying.

According to the Justice Ministry, if Jiang is found guilty of falsifying the marriage, her child's family registration will be corrected and he will lose his Japanese nationality.

But if the fake marriage is not confirmed, the boy will keep his citizenship.

An immigration official said that out of concerns for the baby, it is generally easier for a foreign mother to gain a long-term resident visa if the child has Japanese nationality, even after she divorces her Japanese husband from a fake marriage.

If the woman works in Japan for a certain period, it is easier for her to be granted a permanent resident visa.

And if the mother marries the biological father of the child after her divorce, the father often receives special permission for residence--even if he is living illegally in Japan--to help support the child with Japanese nationality, according to the official.

Immigration officials are concerned that cases of "false paternity" will rise because foreign women seeking long-term stays in Japan can simply pay a Japanese man to recognize a child as his own without going through the fake-marriage process.(IHT/Asahi: October 27,2008)

The wife of a wrongfully convicted man is trying to get the New Brunswick government moving on her husband's demand for compensation.

Erin Michael Walsh was acquitted in March by the New Brunswick Court of Appeal on a 1975 murder conviction.

Walsh, who spent 10 years in jail on the murder conviction and nearly two decades more behind bars for subsequent offences including parole violations, is now suffering from terminal colon cancer.

Court: Confession was coerced in '91 temple deaths

TUCSON, Ariz. (AP) -- A federal appeals court has overturned the confession of a man convicted in the 1991 killings of nine people at a Buddhist temple in Arizona.

The ruling Thursday on Johnathan Doody's appeal means his murder convictions will be overturned and he'll be freed unless he is retried or the government successfully appeals.

Doody was 17 when he was convicted in February 1994 in the slayings of six priests, a nun and two helpers during a robbery at a temple west of Phoenix. He was given a sentence of more than 280 years in prison.

The 9th U.S. Circuit Court of Appeals panel overturned the confession. It found that Doody's statements to investigators were involuntary.

TWO crooks who used hi-tech spying kit to help immigrants cheat in UK citizenship tests have been jailed in the first case of its kind.

Rong Yang, 28, and Steven Lee, 36, wired up Chinese men and fed them information needed to stay in Britain.

The scam involved radio transmitters, laptops and surveillance gear costing thousands of pounds.

Yang and Lee fitted immigrants with tiny button-hole cameras and earpiece receivers.

The pair then sat in a car outside the exam centre.

Candidates, believed to have paid them ￡1,000 each, beamed pictures of the exam paper to the car and were secretly told which boxes to tick.

Police caught Lee and Yang in the act in Wimbledon, South West London.

Assets have since been seized from the pair.

Sergeant Dominic Washington said: “We uncovered a highly profitable criminal enterprise that may be in operation in other parts of the country.”

Lee and Yang were given eight months at Kingston Crown Court.

Two “clients” were ordered to do 180 hours community work.

　１４日午前１１時２５分ごろ、愛知県岡崎市大樹寺１丁目の県道交差点で、白バイに追跡されていた乗用車と豊田市上丘町の主婦竹内淑美さん（３３）の軽乗用車が衝突し、淑美さんが骨盤骨折などの重傷、同乗していた長女夢乃ちゃん（５カ月）が全身を強く打って死亡した。県警は、乗用車を運転していた岡崎市羽根北町２丁目、ブラジル国籍の無職ミルトン・セイジ・アサヒ容疑者（２６）を自動車運転過失傷害と道交法違反（ひき逃げ）容疑で緊急逮捕したと発表した。

　県警によると、事故現場から約４００メートル手前の国道２４８号信号交差点で、ミルトン容疑者が進路変更違反をしたとして、第２交通機動隊の白バイが停止を求めたという。しかし、ミルトン容疑者はそのまま逃げたため、白バイはサイレンを鳴らし続けて追尾。事故現場では、西進中のミルトン容疑者の乗用車の正面が、北進中の竹内さんの軽乗用車の運転席側の側面に衝突していたという。ミルトン容疑者は、現場に車を放置したまま徒歩で逃げたが、同隊員が現場から約１キロ離れた公園で見つけたという。ミルトン容疑者は事故を起こしたことを認めているという。

　第２交通機動隊の入山勇隊長は「現段階においては、白バイの追跡の方法などは適正と判断している」とのコメントを出した。

慶応大の元米国人講師、大麻所持で逮捕…今年２月

　慶応大の元米国人講師（４１）が今年２月、大麻取締法違反（所持）容疑で警視庁愛宕署に現行犯逮捕されていたことがわかった。

　同署副署長などによると、元講師は２月７日、東京都港区のＪＲ新橋駅近くで職務質問を受けた際、リュックサックの中に、大麻樹脂約０・３グラムと乾燥大麻約０・０３グラムを所持していた。３月に、懲役６月、執行猶予３年の有罪判決を受けたが、在留資格の期限が切れていたため、３月１３日に入管難民法違反（不法残留）容疑で強制送還されたという。

　同大広報室によると、元講師は２００５年４月から同大環境情報学部で訪問講師として英会話などを教えていた。

　それはそうと、今日みたカナダのニュースでこんなのがあった。

The defence argued the boy sustained the injury when he leapt from the foster mother's arms, and hit his head on a toilet in the bathroom of her house.

Beresh asked the jury to reject the Crown's theories.・・・・"They have to prove she intended to kill. There is not a scintilla of evidence," he said.

There was a rush to judgment, Beresh argued, and his client was falsely accused.

"The defence only has to raise a reasonable doubt," Beresh said. "But I believe in this trial we've proven her innocence. The fear of a wrongful conviction rests with all of us. Apply your own common sense."

Beresh portrayed the woman as a hockey mom, and someone who hosted barbecues for exchange students.
Beresh also made reference to expert evidence for the defence which found the child suffered from fetal alcohol spectrum disorder. Medical experts who testified for the defence proved the child's death was an accident, Beresh said.

判決前であるが、被告人弁護士のストーリーである。
これだけ、読んで、このストーリーを鵜呑みにするとすれば、かなり、メディアリテラシーが低いか、かなりカナダ、あるいは、その司法に対して不信感があるーーー多分、日本人が北朝鮮に対して抱いているイメージに近いだろう。

で、記事は実は、ちゃんと検察側の話も掲載している。

The Crown has argued the boy died from a fatal head injury caused by the foster mother.・・・・

In his closing arguments Wednesday afternoon, Crown prosecutor Mark Huyser-Wierenga said his theory is not that the accused is a monster.

"I think child abuse is a problem that cuts all across society," he told the jury. "There's no single identifiable group."

Huyser-Wierenga asked the jury to be dispassionate and base their verdict on the evidence.

"This case may bring up an emotional response," he said. "This is about the death of an innocent child. But as a juror you've got to put aside those feelings."

The accused is a manipulator, Huyser-Wierenga told the jury, adding she lied on the witness stand and made up a story about what happened the night the boy sustained a fatal head injury.

The jury is expected to receive their final instructions from the judge and start deliberations on Thursday.

　さて、上記BBCの記事のイギリス人元服役囚の話を鵜呑みにされている方々は果たしてメディアリテラシーが低いのか？それとも日本が北朝鮮並だと思っておられるのだろうか？

　どうも外国人ブログの批判が多くなると、日本についてよく書かないとヒスを起こすおかしなブログだと、思われるのも何だな。まあ、日本に関する英語のブログというのは大抵は普通のブログなのだが、外人さんがおもしろいと思うことでも、日本生まれ日本育ちの日本人からすると、たいして面白くない。で、とくに取り上げないわけだ。ただ、ビックリするようなのがあれば取り上げたい。
　外人さんによる新鮮な視点というのは、面白いし・・・・
　例えば、gaijinsmashさんなんか、いつもサラーと読むだけだが、面白い。
　別に日本のことよく書いてあるわけではない。おもしろ可笑しく書いている。
　文章もうまい。
　漫画にでも映画にでもしたら面白いと思う
　で、リンクした投稿なんか、日本の企業で働いて、日本の会社側の対応により、理不尽なまでの苦労をされている話である。日本人からすると、「しようがない」という面があるが、そうじゃないんだ、という視点が新鮮である。
　といっても、安易に、外人差別や黒人差別に訴えるわけでもない。

　日本人の奥さんをもらった。

正当防衛について、様々な要件があるが、本件で参考になるのは、相当性に関する要件である。この点、ウィキが便利である。

1. 女性Xは駅のホームで帰りの電車を待っていた。そこへ酔っ払いの男性Yがやってきて、Xに執拗にまとわりついた。周囲の人々は笑いながらこれを眺めるばかりでXを助けようとはしなかった。YはXを「馬鹿女」とののしり、胸から首筋のあたりにつかみかかられる状態となった。そこでXは「あんたなんか死んでしまえばいい!」と言ってYの身体を両手でついた。するとYは酔っていたこともあってふらふらとよろめき、ホームから転落した。そこへ運悪く電車がやってきたため、Yは電車とホームに挟まれて死亡した。
2. Aは金の無心に来た友人Bと口論になった。すると興奮したBは「貴様、殺してやる」といってAの胸ぐらをつかみ、素手で殴り掛かってきた。Aは命の危険を感じてこれを払いのけ、床の間に飾ってあった日本刀でBに斬りかかって怪我を負わせた。

　というように、似たような事例でも、正当防衛は認められているのである。

　因みに有道センセは日本人が常識とするあのアメリカでの事件も想起できなかっただろうか？
アメリカでの服部君射殺事件はあまりにも有名である。

1992年10月17日、ルイジアナ州バトンルージュに留学していた日本人の高校生、服部剛丈（はっとり　よしひろ、当時16歳）が、ハロウィンに留学先の友人と出かけた。しかし、訪問しようとした家と間違えて別の家を訪問したため、家人ロドニー・ピアース（当時30歳）から侵入者と判断されて44マグナムを突きつけられ、「フリーズ（「動くな」の意）」と警告された。しかしながら高校生は止まらずに男性の方に進んだため射殺された。

これで、正当防衛が認められた。

なお、民事では、

遺族が起こした損害賠償を求める民事裁判では、刑事裁判とは正反対の結果となった。ピアースが家に何丁も銃を持つガンマニアであり、しばしば近所の野良犬や自宅敷地内に入ってきた犬猫を射殺しており、当日は酒に酔っていて、妻の制止を振り払って家から飛び出し発砲したことなどが実証されたため、正当防衛であると認められないとして653,000ドル（およそ7,000万円）を支払うよう命令する判決が出され、同州最高裁も上告を棄却したため確定した。

日本でも刑事で控訴されなかったとしても、民事での裁判は可能である。

ご家族側の方、納得されない面があれば、民事で今一度吟味してもらう、という手もある。検討されるのも一案かもしれない。

外国人観光客、歓迎と不安で書いたが、有道ブログでも取り上げ、案の定、日本語の読めない外人に、誤解を与えるように誘導している。

Obviously it’s not clear to the masses here that more tourists equals more money and more jobs for Japanese.

It does seem here that the government has once again asked a loaded question, and got the answer they wanted.

日本人は観光客がくれば、日本人にとっても金も仕事も増えるのを理解していない、というコメントがある。日本語が読めれば、出てこない質問である。
有道もあえて、日本人回答者の半数以上は国際交流・地域経済の活性化につながるなどの観点から歓迎していることを説明しない。
