　Time　と言えば、昔英語教育で有名だった松本道弘氏がTimeの速読で英語に強くなろう、などといっていた、あの雑誌である。昔は、ニューズウィークよりも文章が品格があり、視点も深い、などと高く評価されていた、ところが昨今はタブロイド紙化してしまったらしい。その記事は日本のポルノしかも老人によるポルノを扱っている。
　　まあ、おれは英語のエロサイトなど見るから知っているが、こうしたのは、Grannis porn　というカテゴリーで特段めずらしくない。たしかにはじめてみたときはびっくりした。これを日本の正統派週刊誌が正面切って記事にしたらおれはさらにびっくり仰天するだろう。タイムも墜ちたものだ。

　で、さすが、Japan　Probeさん、Timeよ、高級雑誌たれ、と題してStay Classy, Time Magazine投稿してくれている。

　まったくありがたい。感謝に堪えない。目立たんかもしれんが、こうした視点で記事を取り上げてくれるブログとういのは少ない。

Debitoくん　やっぱやきもち？でかいた有道くんの投稿のコメントをみるとパックンあまり人気がないらしい。

　まあ、おれ、あまりテレビ見ないからわからんが、たまーに見ても別に好印象だけどな。

　で、不満をみると、まず、馬鹿なアメリカ人を演じている、ってとことかな？ボビーのときも激しい不満があったようだ。ただ、お笑いというのは所詮、おおよそ、自分を馬鹿にするか、他人を馬鹿にするか、であるから、馬鹿を演じることが悪いとはいえまい。

　以前ボビーに対する批判で、あれは白人が黒人を馬鹿にするような馬鹿な黒人を演じるからそうした黒人のイメージを強化する、というのがあったが、しかし、日本人にはそもそも、例えば、怠け者で馬鹿な黒人という（虚偽の）イメージが定着していない。ボビーはボビー個人のボケとして評価されている、という方が正確であろう。

　パックンの場合は、典型的な馬鹿外人を演じているのだそうだがこれは見ていないからわからん。しかし、外人役をやると、、勘違い！タイプのネタが作りやすいことは確かであろう。

　おれとしては、お笑い外人は外人のイメージを良くする方に貢献していると思う。
クラスの人気者はお笑いのできる子供だろう。また、笑わせてくれるとその人との距離が一挙に縮まる。そうしたことが理由だ。

　日本人の英語下手をからかうのも失礼だ、というようなこともあるが、しかし、お笑いという文脈では、日本人自身が日本人の英語下手をお笑いのネタにすることはよくある。エレベーターでwhich floor　と聞かれて、４のつもりフォア、といったら、whoa　と聞き間違えられた、とか、私は、（参加しないで）こっちで傍聴しています、というつもり、I am outstanding といってしまったとか、空港で、sex　と書かれている空欄に　twice a week と書いてしまったなど、きりがない。

　英語下手をからかうというのは、お笑いの文脈では、要するに、「いじり」であって、特に問題はないように思う。英会話学校や学校の英語の授業でなら別だが、日本人も案外楽しんでいる。
　
　まあ、彼のお笑いを面白く感じない、というならそれはそれで、いいが、しかし、面白くない芸人は山ほどいる。やっぱり、やきもちの部分がないとはいえんだろう。

　外人のイメージは一杯あったほうがいい。例えばバラカンさんのような静かで知的な人とか、ウィッキーさんのよな知的でやさしそうな人がもっとテレビにでればよい。たしか、「ここがヘンだよ、日本人」に出ていた有道くんは、残念ながらまったく人気がなかったんじゃないかな？

　あとついでに、以前に投稿した有道君が引用するJapanTimes の日本における有罪率の高さ関するコメントを見ておこう。
　一つ目の証拠の採用に関してカナダに学びなさい、というもの。
　日本だって、求刑だけして、あとは事実を提出して、裁判官ー検察ー被告（弁護士）という構造になっていることは同じで、また、証拠収集に違法な点があれば、証拠は却下と言う点も同じだ。日本の場合自由心証主義をとるが、カナダの場合は、法定証拠主義ということだろうか？　日本の法制度も知らないで、＾－－－、カナダの法制度を知っているのかもわからないがーーー学びなさい、というのは傲慢に聞こえるが、話がもっと具体的であれば、有益なこともあるだろう。

The attitude that “you just don’t understand us” whenever a change is proposed is sad, but fortunately not universal.
改善の提案があると、君らは理解しておらん、という態度は悲しい。しかし、そうした態度は幸運にも普遍的なものではない。

ある意味、日本だけだと、いいたいのかもしれんが、そもそも記事の投稿に日本人がそんな態度をとったというようなことは書いていない。有道の戯言であろう？

そのほか意味不明のコメント。

　高い有罪率と司法の欠陥を結びつけたいのかもしれんが、それはむちゃくちゃである。厳選され、証拠のはっきりした少数のケースだけ起訴されれば、高い有罪率は当然である。むしろ、低い有罪率の国家が警察・検察件の濫用をして、無実の人の人権侵害をしたのであって、そちらの方が責められるべき、とも言えよう。

　強制自白がある、とい言いたいのかもしれないが、それと高い有罪率の因果関係も不明。

　言えるのはせいぜい、踏み絵などの強制自白に近いケースが数例あったということであろう。それならいい。そして、そうしたケースを撃滅するために、弁護士同伴権、あるいは取り調べ録音義務などを制定すべきた、と論じるのが筋であろう。

　米国の場合、警察が起訴手続きを申請して拒否された率が９６％あるが、これは無実でつかまった人が猛烈に多いことを示す、ということではないのか？浮かぶ監獄
　論者たちの議論は、ここから、米国の警察は全く信用できない、有罪率が低いから検察も信用できない、冤罪が多いから裁判も信用できない、めちゃくちゃだ、もっとカナダを学ぶべきだ、というメチャクチャな論理である。

　日本憎しで頭が狂ってしまったのだろうか、とさえ思う。

立ち読み

　立ち読みってのが好きで、買うと高いし、でも、ちょろっと読んだのが後で何かつながることもある。

　以下、最近の立ち読み。
Client State: Japan in the American Embrace　日本はアメリカの属国じゃああ、というような本らしい。まっペラッとめくって分析というよりもかなり政治色が強そうな感じがしたのですぐに棚に返す。ただ、著者はたしかオーストラリア人だと思うが、オーストらラリアには一部に根強い反日勢力があるようだね。ここらへんは要警戒だね。

こっちの方が、面白くて、（多分）むしろ、日本が「外圧」で動くっちゅうのは神話に過ぎない、といったもの。で、数多くのインタビューを通して見えてきたのは、日本の官僚および政治家には長期的、いや、中期的な展望・戦略さえもない、ということ。悲しいよね。

　で、軍事同盟関係の選択肢を考え、その長所短所をあげる。日米・日中・日露・日ASEAN諸国・自存自衛・・・・ショックだったのはASEAN諸国との軍事同盟はASEAN諸国が弱小すぎてあまり意味がないらしい。
アジアを日米中でとらえるか、あるいは日米中韓露の図式でとらえるか？などの言及があったな。
　韓国は日本に対する歴史問題がネックになっているというが、しかし、列強によって植民化された中で韓国ほど日本の謝罪と補償を受けている国は、他に皆無である。西洋列強の旧植民地を見てみればよい。なんの補償もない。おれが希望するに、はやいところ、韓国も気ちがいじみたナショナリズムから脱皮してほしい。てか、なんでアジア観察者がそれにきづかんのかなあ？

　そういえば、Observing　Japanさんがアジアの地政学的著書を紹介しているが、どうもリアルポリティックスはだめよ、みたいな感じらしい。中国とうまくやるべきなのは、当然で、最近は、関係は改善でいい具合だが、しかし、中国が軍事面での不透明性がある限り話はすすまんじゃないかね？

　ついでに、デビト君がめずらしく政治関係の記事を紹介している。p://www.debito.org/?p=1726　豪首相がEUに匹敵するアジア連合構想をぶちまけている、というわけだが、これは、Observing Japanさんが以前より指摘していたね。どちらかというと、福田のとっつぁんも乗る気である、と。
　EUとは歴史的状況も政治体制の親近性の度合いもちがうのでなかなかむずかしい。ま、方向性として、話のネタにはなる、といった程度か？

　おれとしては、しかし、なんらかの軍事同盟が拡張・成長することによって、世界の平和が維持される時代が来るんじゃないか、とは思っている。世界的国家は必然？　

　ところで、当面確認しておきたいのは、やはり、米国の認識である。
　江田島氏が「日露戦争とその後の日米中関係に見る、20世紀の歴史の教訓　」として、
　

（１）英米は極東では、直接戦闘に参加せず、「日本を代理人」としてランドパワーに対抗すること

　日本がユーラシア大陸に単独で利権をもつことをアメリカは許さない。同様にランドパワー中国が、単独でアジアの支配権を確立しようとすることも許さない。
　従って、アメリカを排除し、中国単独のアジア覇権を目指す『東アジア共同体』をアメリカは絶対に容認しない。

（３）米中が接近すれば、日本の孤立化を生み極東を不安定化する。さらにはアジアでの戦争を生む

　といっているが、現実の軍の配備は別にして、戦略としては、大枠で正しいのではないだろうか？
　だからこそ、米国を巻き込んだアジア諸国との何らかの連合が必要ではないか？
もっとも、米国が

（４）中国を同盟国としたアメリカ民主党の支援は全て裏切られた。

　その最たる例は、蒋介石政権への支援による日米戦争。その結果としての中国大陸を喪失。更には朝鮮戦争での軍事介入。クリントン時代に中国へ供与された核やミサイル技術の中東への流出。

と認識しているか、どうか、そこらへんはわからない。

UKネタ

イギリスでは、紳士クラブ（gentelmen's club)というのがあるそうで、それが増加傾向にありーーお盛んですなーーーー、そこでは、どうも、おねえちゃんがおしり出して、踊ってくれるらしい。で、問題は、この手の「紳士クラブ」が学校の通学路や老人ホームなどにあっても規制されない。そこで、法律をかえな！という話。Sex and the citizen: a licence to thrill?　18 June 2008　The Independent

で、同じくイギリス。保釈制度が変わるという話。殺人で起訴されていながら、保釈された、その隙にまた、殺人犯しちゃった事件があった。まあ、TPRなら怒り心頭でしょうな。で、これからは、殺人で起訴されたら、保釈するのはやめる、という話。因みに、４５５件の殺人容疑で、６０件は保釈されていたそうです。

北アイルランドは誤審率がUKで一番高いそうです。

NI quashed conviction rates highest in UK
The level of quashed criminal convictions is higher in Northern Ireland than anywhere else in the UK.

A report by officials examining possible miscarriages of justice said that a greater percentage of cases were also referred to the Court of Appeal last year.

Sexual offences that were passed as guilty were among the most likely cases to be appealed.

Helena Bracken, Regional Manager north west at the Nexus Institute for victims of sexual attacks, said that it is sending out the wrong message to victims and it looks like everything is stacked in favour of the perpetrators.

Delivery of drugs cases are often challenged with greater modern expertise meaning flaws can be uncovered in technical evidence given during trials.

Before March 2007 there were 131 applications submitted to the Criminal Cases Review Commission and 16 of those were referred to the Court of Appeal, which shows a rate of 14% compared to a UK average of 4%.

Following reviews of the evidence by judges at the Court of Appeal, 13 convictions were quashed which shows a rate of 87% compared to the UK rate of 68%.

None of the statutory agencies were able to provide firm reasons for Northern Ireland's high levels of quashed convictions.４NIcoUK

どうも制度がちがうのかよくわからないところもあるのですが、有罪がひっくり返るケースがUKの中では、北アイルランドは一番高い、ということで、ひっくり返るというのが控訴ということなのか、再審ということかはよくわかりません。まあ、とにかく、誤審と分類されているようです。
　理由はわからない、ということですが、なぜ、わからないですませるのでしょうね。日本なら袋叩きのネタでしょうにね。

北アイルランドではカソリック住民は警察を信用していないそうです。

拳銃をもった男に脅迫されても警察を信用できなので、民間のブローカに依頼せざる得ない、ということです。

カナダの暗い過去

以前の投稿でカナダの首相がカナダの先住民に謝罪を表明をした、というのを扱った。そのなかで先住民に対する性的暴行云々というのがあった。これついて調べてみた。
日本で言えば、アイヌ、あるいはウタリ（ブログ内検索していただきたい）にあたるかもしれない。同化政策、及び、強制移住など類似点もあるだろうが、その状況はかなり違うようである。以下わりにまとまっているサイトhttp://www.libertadlatina.org/Crisis_Canada.htmからひろってみると、

There is no accurate toll of forced sterilizations because hospital staff destroyed records in 1995 after police launched an investigation. But according to the testimony of a nurse in Alberta, doctors sterilized entire groups of Native children when they reached puberty. The report also says that Canadian clergy, police, and business and government officials “rented out” children from residential schools to pedophile rings.

....Arnold Sylvester, who like Dennis Charlie attended Kuper Island school between 1939 and 1945, corroborates this account.
“The priests dug up the secret gravesite in a real hurry around 1972, when the school closed. No-one was allowed to watch them dig up those remains. I think it’s because that was a specially secret graveyard where the bodies of the pregnant girls were buried. Some of the girls who got pregnant from the priests were actually killed because they threatened to talk. They were sometimes shipped out and sometimes just disappeared. We weren’t allowed to talk about this.” (Testimony of Arnold Sylvester to Kevin Annett, Duncan, BC, August 13, 1998).

"These crimes are alleged to have occurred for more than a century in the state-sponsored and church-run Indian Residential Schools which legally interred every Indian child across Canada between the years 1890 and 1984. The consequences of sexual abuse can be devastating. “Of the first 29 men who publicly disclosed sexual abuse in Canadian residential schools, 22 committed suicide,” says Gerry Oleman, a counselor to residential school survivors in British Columbia.

Randy Fred (Tsehaht First Nation), a 47-year-old survivor, told the British Columbia Aboriginal Network on Disability Society, “We were kids when we were raped and victimized. All the plaintiffs I’ve talked with have attempted suicide. I attempted suicide twice, when I was 19 and again when I was 20. We all suffered from alcohol abuse, drug abuse. Looking at the lists of students [abused in the school], at least half the guys are dead.”

The Truth Commission report says that the grounds of several schools contain unmarked graveyards of murdered school children, including babies born to Native girls raped by priests and other church officials in the school. Thousands of survivors and relatives have filed lawsuits against Canadian churches and governments since the 1990s, with the costs of settlements estimated at more than $1 billion. Many cases are still working their way through the court system.

[In the United States:]

Rampant sexual abuse at reservation schools continued until the end of the 1980s, in part because of pre-1990 loopholes in state and federal law mandating the reporting of allegations of child sexual abuse. In 1987 the FBI found evidence that John Boone, a teacher at the BIA-run Hopi day school in Arizona, had sexually abused as many as 142 boys from 1979 until his arrest in 1987. The principal failed to investigate a single abuse allegation. Boone, one of several BIA schoolteachers caught molesting children on reservations in the late 1980s, was convicted of child abuse, and he received a life sentence. Acting BIA chief William Ragsdale admitted that the agency had not been sufficiently responsive to allegations of sexual abuse, and he apologized to the Hopi tribe and others whose children BIA employees had abused.

No one knows exactly how many Indigenous women have been murdered or gone missing in Canada over the past three decades. Because of gaps and inconsistencies in the way that the identities of victims of crime are recorded and made public in Canada, that question simply cannot be answered. However, we do know with certainty that the marginalization of Indigenous women in Canadian society has led to an extremely high risk of violence.

According to a 1996 Canadian government statistic, Indigenous women between the ages of 25 and 44 with status under the federal Indian Act are five times more likely than other women of the same age to die as the result of violence. [1]

で、国連総会で、先住民族の権利に関する国際連合宣言（Declaration on the Rights of Indigenous Peoples）というのが採択され、日本を含む143ヶ国の賛成、オーストラリア、カナダ、ニュージーランド、アメリカ合衆国の4ヶ国は反対にまわった。

　ただ、現状はどうなのか、いまいちわからない。
Aboriginal Perspectivesというサイトでは、教育目的で現在のカナダの若者にひどいことを言われたからやめれ、というビデオを紹介していたり、
写真のように現在でも正義をもとめて教会の前で抗議している、とかはあるが、先住民が現代のカナダ社会で独立を求めているのか？あるいは、当該社会での融合を求めているのかいまいちようわからんかった。
