Sex-Harassment Suit to End in Settlement?
Case Involves Feds, Leucadia And Son of an LDS Leader
Harassment Suit Will End In Settlement
Byline: BY MIKE CARTER THE ASSOCIATED PRESS
A settlement apparently has been reached in an unprecedented federal
sexual-harassment lawsuit against a prominent Utah businessman, the son of a Mormon Church leader.
The defendants -- Leucadia National Corp., owned by Utah entrepreneur Ian Cumming, two of its subsidiaries and a former company officer, Thomas L.Monson -- have agreed to pay former paralegal Jennifer Bottomly an undisclosed sum, her lawyer said Thursday. However, Monson's lawyer, Ellen Maycock, said no paperwork has been signed to finalize any agreement.
"The parties are confident we'll get there," she said. "But we haven'tseen anything to sign yet."
Maycock confirmed that a trial set to begin Monday before U.S. District Judge Dee Benson had been canceled.
The lawsuit included the first-ever intervention by the U.S. Equal Opportunity Employment Commission in a Utah sexual-harassment case.
Bottomly, 35, was fired after she reported alleged sexual harassment by Monson, 45, son of Thomas S. Monson, first counselor in the governing First Presidency of The Church of Jesus Christ of Latter-day Saints.
Thomas L. Monson was fired from his job as vice president and general counsel for American Investment Bank, a Leucadia subsidiary. In her lawsuit filed in 1994, Bottomly claimed she was fired in retaliation for having accused Monson, after first being told her job as a company paralegal was not in jeopardy.
During the discovery process, Bottomly was subjected by defense attorneys to a microscopic scrutiny of her personal life, dating back to her high-school records. She was subjected to 22 hours of depositions by lawyers who had wanted to question her for 10 days.
"It has been a long, hard-fought battle and we're very pleased with the results," said Stan Preston, Bottomly's attorney. The settlement was reached Monday night, he said.
Preston said a strict confidentiality order -- one of several issued in the case -- prevented him from disclosing the amount of the settlement.
"It was a satisfactory result," he said.
Also as part of the settlement, a defamation lawsuit filed in state court by Monson against Bottomly will be dismissed, Preston said.
Monson sued Bottomly for making the sexual-harassment allegations, then sought to have the case file sealed to protect his family, specifically his father's role as a church leader.
Patricia Leith, representing Leucadia and its subsidiaries, American Investment Bank and American Investment Financial, declined to comment on a settlement. In her lawsuit, Bottomly claimed Monson had become obsessed with her "personally and sexually" during her employment at AIB from 1990 to 1993. Bottomly said she was forced to listen to "stories of the most intimate facts of his sexual relations with his wife [and he] repeatedly asked about her sexlife."
Monson, the suit claimed, stalked her, tried to kiss her, searched her belongings, listened to her conversations and repeatedly propositioned her. He also wrote love notes and left "lewd" materials on her desk, including a drawing of two people having sex according to court documents.Bottomly complained to Monson's superiors and filed a complaint with the company in 1993. All the while, she said, she was assured her job was secure.
Monson was fired Sept. 7, 1993. In a deposition, he said he was let go for using poor judgment in his relationship with Bottomly. Bottomly claims that she was twice assured after Monson was terminated that her job was safe. Six days later she was fired after being told an internal investigation showed her claims to be groundless and, according to her complaint, that "her interests were different from AIB."The alleged retaliation was one reason the EEOC entered the case, said Richard R. Trujillo, the commission's regional attorney in Phoenix.
Leucadia, AIF and AIB also settled the intervention complaint with the EEOC, agreeing not to engage in any employment practice that discriminates on the basis ofsxe. The companies will be required to retain a consultant "to provide training sessions dealing with sexual harassment and retaliation" to all of its employees, including corporate officers.
"Management of companies, particularly upper management, has an especially high obligation to implement strong, clear policies and procedures against sexual harassment and retaliation," Trujillo said in a news release dated July 26. That, he said, is especially true for attorneys like Monson. Raymond Fitzgerald, a New York attorney hired by Leucadia, alleged in a June hearing before Magistrate Ron Boyce that the only reason the EEOC had become involved was because of the political mileage to be gained because of Monson's status as a son of a Mormon Church official. Trujillo scoffed at the notion.
"His name and who he is and whatever his status in the community is was not a factor in the commission's decision to seek intervention," he said Thursday. "What we looked at was the egregious nature of the allegations.
The fact that he was a prominent member of the corporation, and a lawyer, was certainly a factor."
