For the sake of transparency, here is a polite riposte just received from the German finance ministry to my irreverent suggestions in yesterday's blog:
透明性のために、ドイツ財務省から拝受した、僕が昨日のブログ・エントリーに書いた無関係な提案に関する礼儀正しい反論を以下に掲載します。Dear Ambrose,Interpret this as you will.

Just a quick line regarding your piece "Merkel breaks German law on ESM rescue".
『メルケル独首相、ESMで独基本法違反』と題された貴エントリにつき、簡単にコメントします。
Here is the relevant section of the June 29 Euro Area Summit Statement (my emphasis):
6月29日のユーロ圏サミット声明における、関連性のある箇所は以下の通りです（強調します）：
"The Commission will present Proposals on the basis of Article 127(6) for a single supervisory mechanism shortly. We ask the Council to consider these Proposals as a matter of urgency by the end of 2012. When an effective single supervisory mechanism is established, involving the ECB, for banks in the euro area the ESM could, following a regular decision, have the possibility to recapitalise banks directly."
「委員会は近日中に、単一の監督機構を第127（6）条に基づき提案する。我々はこれらの提案を2012年末までに緊急性を以って検討することを理事会に求める。欧州中央銀行が関与する、ユーロ圏の銀行のための効果的な単一の監督機構が設立された場合、欧州安定化メカニズムは、通常の決断に従い、銀行の直接資本増強を行えるようになる可能性がある」
To sum it up: the Council will consider the Commission's proposals by the end of 2012. It may then decide to set up a single bank supervisor (for the EU or the Eurozone). Once this supervisor is up and running, a regular decision will be made as to whether the ESM should be allowed to recapitalise banks directly.
要するに、理事会は委員会の提案を2012年末までに検討するということです。その後、（EUまたはユーロ圏のための）単一の銀行監督機構を設立するかどうかを決断するかもしれません。この監督機構が設立、稼動されれば、欧州安定化メカニズムが銀行の直接資本増強を行うことを許されるべきか否かについて、通常の決断が下されるのです。
As you can see, there will be plenty of time for the Bundestag to get involved.
お分かりになる通り、ドイツ連邦議会が関与する時間はふんだんにあるでしょう。
Hence no German law has been broken.
従って、ドイツ基本法違反は一切ございません。

It strikes me that the European Commission and others have gone much too far in claiming that the ESM will indeed recapitalise banks.
欧州安定化メカニズムは銀行の資本増強を行うようになる、という欧州委員会その他の主張はお手付きだった、というように僕には読めました。
The German Bundestag has not given any such authorisation. It may do so at some point in 2013, or it may not. The current finance legislation specifically prohibits it.
ドイツ連邦議会はそのような権限を一切与えていません。
2013年に入ったらそうすることもあるかもしれませんし、ないかもしれません。
現行の財政に関する法律はそうすることを明確に禁じています。
As for breaking the law, the question is what Chancellor Merkel agreed to verbally behind closed doors. The comments by the Spanish and others suggests that she may have promised much more than appeared in the formal conclusions – arguably in breach of her Bundestag mandate.
さて法律違反ですが、問題は、アンゲラ・メルケル独首相が閉ざされた扉の向こうで口頭で合意したことはなんだったのかということです。
スペインその他のコメントによると、メルケル独首相は公式声明から読み取れるよりも遥かに多くのことを約束したのかもしれないとのことですが…議会が認めた権限の逸脱はほぼ間違いありません。
Since German president Joachim Gauck has told her to come clean on exactly what she agreed in Brussels, we may soon find out.
ヨアキム・ガウク独大統領が首相に、ブリュッセルで何にイエスと言ってきたのか全て明らかにしろ、と命じたのですから、僕等も間もなく知ることになるかもしれません。
