Eighteen GSK China staff held as whistleblower allegations emerge

GlaxoSmithKline, the British drugs company that is the subject of a major criminal investigation in China, faced similar allegations from an internal whistleblower as early as January, The Sunday Telegraph can reveal.

Details of the claims made at the start of the year emerged as Chinese police widened their inquiry into the company, putting 18 more GSK employees in detention, according to state media reports.

An email from an anonymous whistleblower sent on January 16 to the entire GSK board, its auditors and several public relations staff, and copied to the Serious Fraud Office, appears to describe many of the same claims that are now being investigated by Chinese police.

However, GSK has repeatedly said it only became aware of the specific problems identified by police two weeks ago.

In the wake of the whistleblower email, GSK said it conducted a four-month internal investigation but "found no evidence of corruption or bribery".

But the allegations listed in the email appear to be very similar to some of the wrong-doings now being alleged by Chinese investigators.

The whistleblower's email, a copy of which has been seen by The Sunday Telegraph, claimed that "almost every" new GSK sales employee was wired 10,000 renminbi (￡1,060), into "their personal bank accounts".

"The cash advance is to be used for business purposes, not personal use. Each employee has significant discretion as to how best to utilise his or her cash to maximise sales," it claimed.

The email alleged this money, which was replenished each month, was used to pay cash bribes to doctors to prescribe drugs. It also mentions that travel agencies were used by GSK to arrange doctors' trips. "The sales team decides who the most important decision makers are at the hospitals and invites those doctors to attend an international conference," it claimed.
同メールは、毎月給付される当該資金は、医師に処方させるための賄賂として使われていたとしています。
また、GSKが医師の旅行を手配するために使っていた旅行代理店についても触れています。

"GSK sets up accounts at a travel agency for those doctors. The travel agency then takes care of the doctors' airline tickets, hotel rooms, and gives them cash to cover both meals and sightseeing excursions. The travel agency then invoices GSK."

Chinese police allege that GSK sales people in the country used a network of travel agencies to disguise bribes as invoices to attempt to shield the true source of money.

Until news of the further 18 arrests, only four GSK China staff were known to have been detained by police.

Sir Andrew Witty, group chief executive, last week insisted the claims made in January involved a "completely different set of issues".

A GSK spokesman said: "We understand that the allegations made by the Chinese authorities in the ongoing investigation are different and separate to the whistle-blower's particular allegations."

He added that GSK's inquiry "did not support the specific allegations".
