書類を送る時に
大切な書類は宅急便を利用してますが
少し前に信じられない事が起こりました。
それはその大切な書類を積んだ配送車が
事故を起こして全焼してしまったのです。
書類も当然灰になったと思われます。
困りますよね
大切な書類ですから
まぁしかしその後のやり取りで
大切な書類と言っても
実際には大切では無かった
ってのが良く分かりますね。
それは
相手方の対応です
普段であれば厳しく書類の管理を求めてきますが
今回のように災害となれば
あっさりしたものです。
宅急便の会社にそれを証明して貰えば
もうそれで終わり
書類を再度作る必要も無いそうです。
これまで２０年以上毎月送付していましたが
その程度の物だったんだ
って思って拍子抜けしましたね。
でも
だとすれば何でその書類の提出を求めたのでしょうか？
まぁ言うまでもありませんね
契約の意思確認のためにそうしてるのです。
では何で今回は必要ないか？
って言うと
民法の規定では契約の成立条件に書類の作成は無いからです。
つまり
書類なんか無くても
お互いに意思を持っていれば
契約は成立する
って訳です。
だから今回のように
止む得ない事情があれば
強いて書面の提出は求めない
まぁ理に叶った対応ですね。
ただ今回はそうなんですが
今の世の中
本当に無駄な書類をたくさん作らされますよね。
私は意味のない書類の作成は苦痛で
いつもいやいやながら従ってるって感じです。
作成でなくても
意味のない書類の提出
これも腹立ちますよね。
最近もある保険手続きで
保険引き受け会社が私に
“会社の謄本はありますか？”
って聞いてきたので
“私は５か月前のならあります”
って伝えると
相手は申し訳なさそうに
“３か月以内のをお願いします”
って言ってきました。
まぁ役所でもなんでも同じ事を言いますからね
仕方がありません
私はすぐに法務局に行って新しい謄本を取ってきました。
それからすぐにその保険会社の人がやってきて
私が提出した謄本を見て
“ありがとうございました確認しましたので結構です”
って謄本を返してきました。
私は
“それ御社が必要な書類では無いんですか？”
って言うと
“当社では必要ありません、御社が間違いなく登記されてるかどうかの確認だけです”
で私
少しカチンと来て
“その程度であれば５か月前の謄本でも良いのではありませんか？”
って聞くと
“いえ3か月以内の謄本で確認する事になっています”
で私
“何で？”
って聞くと
“5か月前には登記してあったかも知れませんが
3か月前には登記が抹消されてる可能性があります。“
またカチンと来ましたね。
で
“その理屈で言うと
3か月前には存在していたとしても
その後抹消した可能性もありますよね“
って言うと。
“そこのところは柔軟に対応してます”
って答えてきました。
で私
“その謄本確認は会社の指示ですか？”
って聞くと
“そうです”
って言いましたので
“では会社に戻ったら上司に
本当に会社の登記を確認したいのであれば
いちいち謄本を取らなくても
ネットで今現在の状況を確認できますから
って伝えたらどうでしょうか？“
って進言すると
“ネットで確認できる事は私たちも知っていますし実際にそうしてます”
って話でした。
まぁカチンを通り越してムカつきましたね。
“って事は
“すでにネットで当社の登記の確認はできてるのに
わざわざあなたが見るためだけに謄本を取りに行かせたの？“
って聞くと
明らかに不快そうに
“そうですが何か問題でしょうか？”
ですって
まぁこれ以上やりあっても時間の無駄ですから終わりにしましたが
私は本当にこんなたぐいの
意味のない事をやらせるのが苦痛なんです。
まあこの性格は嫌われるのも分かっていますが
我慢するのも精神衛生上悪いし
ストレスも溜まり体に悪いですからね
ですから
申し訳ありませんが
その会社とのおつきあいは
これっきり
って決めさせていただきました。
私
多分
石丸伸二さんと性格が似ていますね。
もう直しようもありませんから
理屈の通じない人は極力避ける
これからはそんな生き方になります。
When I send sending documents,
I use courier services to deliver important documents,
but something unbelievable happened a while ago.
The delivery truck carrying those documents had an accident and burned down.
The documents were reduced to ashes, of course.
It's a problem, because they're important documents.
But the subsequent exchanges made it clear that even though I was thinking important
they weren't actually important.
Normally, they would ask for strict management of documents,
but in a disaster like this,
they were not care about it
Once the courier company certifies accident
It was over
there's no need to make the documents again.
I've been sending them out every month for over 20 years,
so I was surprised to know that they were just that important.
But if that's the case,
why did they ask for the documents?
Well, it goes without saying,
they do it to confirm the intention of making contract .
So why isn't it necessary this time?
Because the Civil Code does not require the creation of documents as a condition for the formation of a contract.
In other words, even if there are no documents,
as long as both parties have the will, a contract will be formed.
So, if there are unavoidable circumstances like this time,
it is a reasonable response not to force the submission of written documents.
However, in today's business
we are forced to create a lot of useless documents.
I am painful to create meaningless documents,
so I always have to follow them reluctantly.
Even if you don't create them,
submitting meaningless documents is also annoying.
Recently, during an insurance procedure,
the insurance underwriting company asked me,
"Do you have a copy of the company's certificate?"
When I told him
"I have one from five months ago,"
he said apologetically,
"Please give one from within three months."
Well, government offices and other places say the same thing,
so there's nothing I can do but follow his instruction
I immediately went to the Legal Affairs Bureau and got a new copy.
So soon after,
That man came to my office
He looked at the copy which I had submitted,
and said,
"Thank you, I checked it, so it's fine,"
and returned the copy.
I asked,
"Isn't that a document that your company needs?"
"We don't need it, we just need to confirm that your company is definitely registered."
I got a little annoyed and asked,
"If it's just that, wouldn't a copy from five months ago be fine?"
"No, we're supposed to check with a copy from within three months."
I asked,
"Why?"
"It may have been registered five months ago, but it may have been nullified three months ago."
I got annoyed again.
So I said,
"By that logic, even if it existed three months ago, it may have been cancelled since then."
He replied,
"We're flexible about that."
So I asked,
"Was it the company's instruction to check the certified copy?"
He said, "Yes."
So I suggested,
"Well, when you get back to the office, tell your boss that if he really wants to check the company's registration, you don't have to get a certified copy every time, you can check the current situation online."
He said,
"We know that we can check it online, and we actually do that."
Well, I was more than annoyed. anger
"So, you mean,
"You can already check our company's registration online, but did you force me to go legal affairs office to get a certified copy just for you to see it?"
He looked clearly annoyed and said,
"Yes, but is there a problem? "
Well, I decided to end it because it would be a waste of time to continue,
but I really feel painful to be compelled to do such a meaningless job
I know people dislike this personality,
but putting up with it is bad for my mental health,
and it also builds up stress and is bad for my body,
so I'm sorry, but I've decided that this is the last time I'll be dealing with that company.
I think my personality is similar to Ishimaru Shinji's.
There's no way to change it now,
