判決は、３人が１０メートルを超す津波の情報に接したのは０８年６月～０９年２月ごろで、それから浸水対策や高台への施設移転などの工事を始めても東日本大震災までに完了したか明らかでないと指摘。事故を防ぐには１１年３月初旬までに運転を止めるしかなかったが、生活・経済を支える原発の「有用性」を踏まえれば、その判断にはあくまで当時の安全基準に基づいた慎重な検討が必要とした。

　その上で、１０メートルを超す巨大津波を予見できたかを検討した。「決定的に重要」な判断材料としたのは、国が０２年に公表した地震予測「長期評価」だ。東北沖でマグニチュード８・２前後の津波を伴う地震が来る可能性を示したもので、東電子会社はこれに基づく計算で０８年３月、原発に「最大１５・７メートル」の津波が来るという予測を報告した。

地震対策を話し合う０９年２月の「御前会議」に３人が出席した際、担当部長が「１４メートル程度の津波が来る可能性」について言及したと指摘。３人はこうした情報に接してもなお、収支の悪化を嫌がって、防潮堤を高くしたり原発の運転を止めたりする対策をとらなかったと批判した。

　これに対し、武藤氏は長期評価の信頼性に疑問があったとし、自身の指示について「専門家に確認するのは自然なこと」と述べ、先送りの意図を否定。武黒氏も１５・７メートルという予測について、部長から「当てにならない計算と言われた」と説明した。勝俣氏は「部長の発言のトーンは非常に懐疑的だった」と反論した。

　さらに弁護人は、「最大１５・７メートル」の津波は敷地の南側から来ると予測されていたのに、実際の津波は東側の全面から押し寄せたと指摘。想定に従って南側に高い防潮堤を設けたところで効果はなく、３人は事故を防ぐ義務を怠ったとは言えないと述べていた。


有用性を重視すぎるのもいかがなものか、とは思うが、予見可能性があったかどうかは微妙で、仮に提出された予見に基づいて対策していても防げなかった、ところから、損害との因果関係がどうなかなああ、といったところだろう。

PROPORTIONALITY PRINCIPLE

Like the principle of subsidiarity, the principle of proportionality regulates the exercise of powers by the European Union (EU). It seeks to set actions taken by EU institutions within specified bounds. Under this rule, the action of the EU must be limited to what is necessary to achieve the objectives of the Treaties. In other words, the content and form of the action must be in keeping with the aim pursued.


The Federal Constitutional Court of Germany has since developed the proportionality principle with three elements: (i) Suitability (the measure should be suitable for achieving the desired objective); (ii) Necessity (a less restrictive means should be used if it is equally effective); and (iii) Proportionality in the strict sense (the measure should not be disproportionate to the objective).

これはその通りだね。ただ、いまの風潮だと、韓国に批判的で手厳しい対応をとれ、というbuvery氏のツイートは嫌韓だ、ヘイトだという人も出てこよう。

外国人で、日本を批判すると反日だ、という右翼がいるように。

ちなみに、現在「害になれば捨てて妨害する」状態なのに、日本政府は有効な手立てをなにもうっていない。

イエメンの人びとは自分の年齢や誕生日を知っている人はいない。（年齢に関わらず）お互いが敬意を払っているから、年齢には関心がない、と。
また、物質主義という観念もない。豊かさより家族や友達のほうが重要なのだ、と。

　イエメンの人びとの評価については、動画作成者の美化があるかもしれない。実際に、敬意を払っているのか、物質主義に魅惑されないのか、それはわからない。

　しかし、年齢の観念がない、というのはおもしろいですね。

　日本の年功序列的な先輩、後輩の観念は、役立つこともあったのかもしれんが、有害な場合のほうがおおいんじゃないか、と思うね。

　ちなみに、年齢の観念がなくても、あることの経験について後先の観念はあり得るから、先輩、後輩という観念がない、とはかぎらない。

Got that? All told, 40% of their cross-section of respondents expressed agreement with positions in support of the total destruction of American society. And a large number of those people likely voted for Donald Trump, according to the researcher himself, Michael Bang Petersen, as Edsall reports.

In an email, Petersen wrote that preliminary examination of the data shows “that the ‘need for chaos’ correlates positively with sympathy for Trump but also — although less strongly — with sympathy for Sanders. It correlates negatively with sympathy for Hillary Clinton.”

The study still doesn’t address that important question of what actually happened to these people to cause this epidemic of nihilism. It wasn’t “economic anxiety,” or “racism.” ‘Neither of those things in and of themselves would make a person want to go out and destroy the world for the sake of destroying it.

小熊英二さん「もうもたない!? 社会のしくみを変えるには」
質問と回答がうまく噛み合っていないところもおおいし、どうすればいいか、の点で、納得いかないところもあるが・・・


――平成から、令和の時代になって半年が経ちました。平成の間は契約社員や派遣社員が増えたり、地方では、商店街がなくなってショッピングモールが出来たりといった変化がありましたが、社会が大きく変わったということでしょうか。

「どのポジションから見るかによって、全然見え方の違う30年」だったと思いますね。日本社会の約26%に当たる、大企業の正社員や官庁勤めの方から見れば、「変わらなかった時代」。ただ、それ以外の人たちにとってみれば、かなり大きな変化があった時代だと思います。

いわゆる日本型雇用が変わらないといわれるのは、上の3割の安定性を、下の7割から非正規雇用を調達しながら、ずっともたせてきたということです。


――その後、徐々に貧困や格差の拡大が問題視されるようになってきました。しかし、「しくみ」は変わらず、なかなか対応は進まなかったように思います。

貧困と格差という問題に関して、社会がどのように気づくか、という「気づき方」も、一貫して社会の上のほう、上位約26％に関係する変化がまず注目されていたからだと思います。やはりどうしても、メディアやものを論じる人たちのリアリティーというのは、「上の方のリアリティー」ですから。メディア労働者や官僚は彼ら自身が「大企業型」だし、学校の同級生もほとんど「大企業型」でしょうから、日本全国みんな「大企業型」だと思いやすいのでしょう。


これから、上級国民の既得権益をぶっ飛ばす、政党が右か左からでてくると伸びるのではないか、というのが私の読み。

　

憲法制定当時は同性婚を否定する趣旨とは言えない
