高橋裁判長は「『研修』とは名ばかりで実態は労働者だった」と指摘。研修１年目は禁止されている時間外労働もあったとした上で、県内の最低賃金額を適用し、未払い賃金や残業手当などとして約１２９０万円、慰謝料などとして４４０万円の支払いを命じた。
また経営者が４人の預金通帳や印鑑を管理していたことは労働基準法で禁止された「強制貯金」にあたるとし、逃亡を防止しようと旅券を預かったことも「違法な労働状態を助長する」とした。
受け入れ機関については、「違法な就労や管理が行われていないか適正に監査すべきだったのに何も指導しなかった」と不法行為を認めた。

For the United States to step forward as a defender of helpless countries matched its image in American high school history textbooks, but not its record in world affairs. It had opposed the Haitian revolution for independence from France at the start of the nineteenth century. It had instigated a war with Mexico and taken half of that country. It bad pretended to help Cuba win freedom from Spain, and then planted itself in Cuba with a military base, investments, and rights of intervention. It had seized Hawaii, Puerto Rico, Guam, and fought a brutal war to subjugate the Filipinos. It had "opened" Japan to its trade with gunboats and threats. It had declared an Open Door Policy in China as a means of assuring that the United States would have opportunities equal to other imperial powers in exploiting China. It had sent troops to Peking with other nations, to assert Western supremacy in China, and kept them there for over thirty years.
While demanding an Open Door in China, it had insisted (with the Monroe Doctrine and many military interventions) on a Closed Door in Latin America-that is, closed to everyone but the United States. It had engineered a revolution against Colombia and created the "independent" state of Panama in order to build and control the Canal. It sent five thousand marines to Nicaragua in 1926 to counter a revolution, and kept a force there for seven years. It intervened in the Dominican Republic for the fourth time in 1916 and kept troops there for eight years. It intervened for the second time in Haiti in 1915 and kept troops there for nineteen years. Between 1900 and 1933, the United States intervened in Cuba four times, in Nicaragua twice, in Panama six times, in Guatemala once, in Honduras seven times. By 1924 the finances of half of the twenty Latin American states were being directed to some extent by the United States. By 1935, over half of U.S. steel and cotton exports were being sold in Latin America.
Just before World War I ended, in 1918, an American force of seven thousand landed at Vladivostok as part of an Allied intervention in Russia, and remained until early 1920. Five thousand more troops were landed at Archangel, another Russian port, also as part of an Allied expeditionary force, and stayed for almost a year. The State Department told Congress: "All these operations were to offset effects of the Bolshevik revolution in Russia."

So long as Japan remained a well-behaved member of that imperial club of Great Powers who-in keeping with the Open Door Policy- were sharing the exploitation of China, the United States did not object. It had exchanged notes with Japan in 1917 saving "the Government of the United States recognizes that Japan has special interests in China." In 1928, according to Akira Iriye (After Imperialism,), American consuls in China supported the coming of Japanese troops. It was when Japan threatened potential U.S. markets by its attempted takeover of China, but especially as it moved toward the tin, rubber, and oil of Southeast Asia, that the United States became alarmed and took those measures which led to the Japanese attack: a total embargo on scrap iron, a total embargo on oil in the summer of 1941.
As Bruce Russet says (No Clear and Present Danger): "Throughout the 1930s the United States government had done little to resist the Japanese advance on the Asian continent," But: "The Southwest Pacific area was of undeniable economic importance to the United States-at the time most of America's tin and rubber came from there, as did substantial quantities of other raw materials."
Pearl Harbor was presented to the American public as a sudden, shocking, immoral act. Immoral it was, like any bombing-but not really sudden or shocking to the American government. Russett says: "Japan's strike against the American naval base climaxed a long series of mutually antagonistic acts. In initiating economic sanctions against Japan the United States undertook actions that were widely recognized in Washington as carrying grave risks of war."
Putting aside the wild accusations against Roosevelt (that he knew about Pearl Harbor and didn't tell, or that he deliberately provoked the Pearl Harbor raid―these are without evidence), it does seem clear that he did as James Polk had done before him in the Mexican war and Lyndon Johnson after him in the Vietnam war-he lied to the public for what he thought was a right cause. In September and October 1941, he misstated the facts in two incidents involving German submarines and American destroyers. A historian sympathetic to Roosevelt, Thomas A. Bailey, has written:
Franklin Roosevelt repeatedly deceived the American people during the period before Pearl Harbor. ... He was like the physician who must tell the patient lies for the patient's own good ... because the musses are notoriously shortsighted and generally cannot see danger until it is at their throats. .. .
One of the judges in the Tokyo War Crimes Trial after World War II, Radhabinod Pal, dissented from the general verdicts against Japanese officials and argued that the United States had clearly provoked the war with Japan and expected Japan to act. Richard Minear (Victors' Justice) sums up Pal's view of the embargoes on scrap iron and oil, that "these measures were a clear and potent threat to Japan's very existence." The records show that a White House conference two weeks before Pearl Harbor anticipated a war and discussed how it should be justified.
A State Department memorandum on Japanese expansion, a year before Pearl Harbor, did not talk of the independence of China or the principle of self-determination. It said:
. . . our general diplomatic and strategic position would be considerably weakened-by our loss of Chinese, Indian and South Seas markets (and by our loss of much of the Japanese market for our goods, as Japan would become more and more self-sufficient) as well as by insurmountable restrictions upon our access to the rubber, tin, jute, and other vital materials of the Asian and Oceanic regions.

So we must now, fifty-five years later, with those bombings still so sacred that a mildly critical Smithsonian exhibit could not be tolerated, insist on questioning those deadly missions of the sixth and ninth of August, 1945.
In fact, the bombs that fell on Hiroshima and Nagasaki did not forestall an invasion of Japan because no invasion was necessary. The Japanese were on the verge of surrender, and American military leaders knew that. General Eisenhower, briefed by Secretary of War Henry Stimson on the imminent use of the bomb, told him that "Japan was already defeated and that dropping the bomb was completely unnecessary."
But scour the textbooks that Americans use in schools, and you won't find any serious discussion of our own comfort women. I speak, of course, of female African-American slaves...

Gandul reads about the story of a 13 year old Romanian girl who attempt to kill herself, as her colleagues accused her of smelling like a Romanian. Her parents told newspapers that their little girl has many friends and knows Italian at perfection.
Her mother confessed that her child complained about the attitude of her colleagues and professors alike but she said she thought it is normal, as kids always fight. The family lives in Italy for five years now.
Her father says that even some of her professors mistreat her. The little girl's case is not a singular one, either.

HINDUS AND Jews have asked for a thorough investigation into why in central Romania over 100 Roma were forced to live in metal cabins behind sewage works after being forcibly evicted from their homes, as reported by Amnesty International.
According to this report titled “Treated like waste”, which was posted on January 26 on Amnesty website, many of these included families with children. Report quotes Erszebet, who lives next to the sewage treatment plant with her husband and nine children, and who told Amnesty International what life was like in a metal cabin: “It is tight; when the whole family goes to sleep we don’t fit in. We cannot take a bath; we cannot clean ourselves. It is too small. We don’t want the older girls to take a bath in front of their father.”
According to Amnesty, there are about 2.2 million Roma in Romania – making up about 10 per cent of the total population. As a result of widespread discrimination, both by public officials and society at large, 75 per cent of Roma live in poverty, as opposed to 24 per cent of Romanians and 20 per cent of ethnic Hungarians.

I’m not speaking in support of a universal and compulsory ID system. I’m speaking in opposition to the Japanese system, where based on a “foreigners who dare remain in Japan postwar are potential subversives” historical attitude only NJ have to be tracked 24-7 with criminal penalties for nonobservance, while citizens are all trustworthy and don’t need to carry universal ID. Why is it that only citizens have “privacy concerns” that need respecting?.

Romania has overtaken Russia as the top country of origin of migrant sex workers in the EU, a survey of prostitution across the EU has found.
In 2006 the top countries of origin were Russia, Ukraine and Romania - in that order, the Tampep network reports.
But in 2008 the top three were Romania, Russia and Bulgaria. Romania and Bulgaria joined the EU in 2007.
Tampep's data collection is part of an effort to curb the spread of HIV/Aids and other sexually-transmitted diseases.
According to the survey, Central and Eastern Europe, including the Baltic and Balkan countries, account for around 70% of migrant sex workers in the 27-nation EU.
The next largest groups come from Africa (12%) and Latin America and the Caribbean (11%).
Tampep, which is based in Amsterdam, reports that about 70% of all sex workers in the older EU member states are migrants. The proportion of migrants is far smaller in the new member states which joined the EU in 2004 and 2007.
Italy, Spain, Austria and Luxembourg report that migrants comprise 80% to 90% of the sex worker population.
The greatest balance between migrants and nationals is found in Portugal (56% migrants) and the UK (41% migrants). In the UK, the highest concentration of migrant sex workers is in London - 80%.

Four young Romanians, aged between 17 and 25, were arrested by PSP, for having kidnapped a prostitute,in order to control the business part of the city of Lisbon.
The targets were also women of Romanian origin working as prostitutes in the vicinity of the Forum. “They appear here for more night, then from 22 hours,” pointed to a woman JN Portuguese prostitute who is also in the area.
A Sunday Telegraph investigation into human trafficking has recently exposed how women can be bought in Romania, a prime "country of origin" for trafficked women, and how many victims are beaten, raped and sold on to traffickers in countries including Britain, Greece, Italy, Germany and Spain.
One woman is wearing knee-length boots that do not match. Most of them come from poor families and, on film, they tell how they were deceived into leaving their homes. A Romanian, whose name has been withheld to protect her identity, says: "My situation at home was very difficult and there is no work in my area.
"I was offered work abroad by a man I had known for a long time and when he promised me a better life I believed him. But it was just a lie. He took me to Serbia and sold me and I ended up in Macedonia."
Another woman was sold by a man who promised her a job in Germany as an au pair. "My hopes were crushed," she said.
Another Romanian victim, sold by a woman who promised her work in Italy, said: "I had heard stories about women being bought and sold like merchandise but I didn't believe them - and I never dreamt it would happen to me."
An organisation which works with women involved in prostitution has warned that Ireland is now "firmly enmeshed in the global sex trade".

判決はまず、自己のプライバシー情報の取り扱いについて自己決定する権利（自己情報コントロール権）は憲法で保障されているプライバシー権の重要な一つになっているとし、住基ネットが扱う氏名、生年月日、性別、住所の４情報について「私生活上の平穏が侵害される具体的危険がある場合は、自己情報コントロール権が侵害されたことになり、本人確認情報の利用の差し止めはできる」との判断を示した。
情報漏洩（ろうえい）の危険性については、自治体でセキュリティー対策が施されるなど具体的な漏洩の危険は認められないとしたが、個人情報を利用する国の事務が２７０種を超えて拡大し続けている現状などを指摘。行政機関が住民票コードをマスターキーのように使い、個人情報が際限なく集積・結合されて利用されていく危険性があるなど、住基ネットの制度自体に欠陥があると断定した。
氏名、生年月日、住所などが掲載された運転免許証を運転時に携帯することを義務づけられていることが、まずい、とでもいうのだろうか？

“Japan’s proposed answer to that was the Juuki-Netto System early last decade, and it came under fire quickly for “privacy concerns” (well, fancy that).”
Funny how they were quick to cite “privacy concerns”, yet everyone gives away their information freely whenever they register for one of the billion “point card systems” out there.
I take it the Juuki-Netto System was / is not mandatory, right? In my humble view, the government should enforce it and bring Japan in line with the rest of the civilized world (where state-issued ID cards are a given).

Most lifeguards are understandably worried about swimmers drowning while they're on the job. But the safety officers at this beach on the southern Victoria coast Down Under say they're too busy "combing the sand for syringes and broken glass," according to Melbourne's Herald Sun. Sharp debris has plagued the area since 2005, when a seven-year-old boy was pricked by a needle in the sand and rushed to the hospital. Last year, the Port Philip Council picked up one thousand tons of trash on the shore and blamed a combination of storm-water runoff and litterbugs. Hopefully they're not members of the country's rising HIV-infected population.

Perfume bosses at House of Fraser claim shoppers are put off by the smell of the store's trendy Yo! Sushi restaurant. And they said the delicate aroma of exotic scents by top designers including Chanel, Dolce and Gabbana and Yves St Laurent was being smothered by the fishy smells from the Japanese eatery. One customer at the store on Glasgow's Buchanan Street said: "I went in to go to Yo! Sushi and when I asked one of the assistants where it was I was told 'Follow your nose'. He wasn't joking." Yo! Sushi opened in the posh department store in September and sells a array of Japanese dishes from its conveyor belt, including prawns, eel and octopus. Restaurant bosses have now been asked to tackle the smell and may have to invest in a new ventilation system. A spokeswoman for House of Fraser said: "We are aware of the issue and are working with the brand at present to resolve this." A Yo! Sushi spokeswoman added: "We might be in talks, but there's no plans for a ventilation system."
In one of her blog posts, Maria told readers that she and her son had been attacked on a city train. One of the passengers pushed Maria when she, Bo and their son were getting off the train. Ironically, David Drummond – Google's chief legal officer who penned its stunning announcement this week – is facing criminal charges in Italy. Why? Because last year YouTube staff failed to act quickly enough to remove all copies of a video clip of an autistic child being bullied by his classmates. The core issue is a tough one for democracies: when awful people put ghastly video on the internet, with devastating consequences to innocent people, who should be held responsible and punished? Google's lawyers argued that staffers acted in good faith and removed the offending video as soon as they were made aware of it. The Italian prosecutors countered that Google had failed to do enough to prevent harm to an innocent child.
In France, President Sarkozy's government has created a new agency called the Higher Authority for the Distribution of Works and the Protection of Copyright on the Internet. It requires internet service providers to monitor users for piracy of copyrighted music and video and send warnings to violators. A violator who ignores all warnings and persists would be brought before a judge and, if found guilty, could have their internet service cut off. While free speech activists pushed for a court hearing to be included in the legislation – the original bill didn't even involve the due legal process of a court hearing – serious concerns remain about the extent to which ISPs will be required to monitor the actions of their users, and whether these surveillance functions could be abused.
The UK's digital economy bill would involve similar measures – sparking similar concerns from civil liberties groups about privacy and surveillance, and whether there will be sufficient public oversight and accountability of the system to prevent abuse.
In India, a law that went into effect last October holds domestic and international internet companies – including Yahoo!, Facebook, YouTube and Twitter – accountable for helping to maintain "public order, decency, or morality". Companies are expected to be proactive about removing potentially inflammatory material. Failure to comply can result in jail terms for executives of up to seven years. The main impetus behind the law is religious violence – an ongoing problem in India that can be inflamed by hate-filled postings.
They appeared intended to amplify the government's case that its Internet controls are for it to decide, and expressing non-violent views online can be a crime in China.
Monday, the paper said Washington was hypocritical about Internet controls, noting the U.S. has laws seeking to restrict images and words that can be seen by children.
