裁判官は自分自身の中に存在する

最近NHKで法医学のドキュメンタリー番組が放送されてましたので見ましたが

まぁ驚きましたね。

テレビドラマでもたくさん出て来る法医学

当の先生方の話によると

明らかに外傷があるような場合を除いて

実際には解剖して調べても死亡原因なんてほとんど分からないし

死亡推定時刻もあてにならない

んだそうです。

まぁしかしだからと言って法医学が不要

って事にはなりません。

不確かであっても法医学の名前が示す通り

裁判では必要ですからね

ただ

インタビューを受けた法医学の先生が言ってた言葉

これは衝撃的でしたね。

法廷は建前は正義ですが

実際には検察も弁護人も考えてる事は裁判に勝つ事だけ

だそうです。

ですから

不確かな解剖結果も

お互いに都合の良いように解釈して

裁判に勝とうとするんだそうです。

まぁしかしこれも仕方が無い事でしょうね

お互いに自分の主張が通るように裁判をする訳で

これが実際に正しいのかどうかなんて関係ない

って事でしょう。

ですから

冤罪もたくさんあるし

重犯罪の見逃しも同じように多発する

これが裁判の実態だって事です。

この話

私たち一般国民はしっかり頭に入れたいですね。

つまり法医学はあてにならないのであれば

それを元に展開する裁判も

必ずしも正しい判決が下る訳ではない

って事です。

と言うことは

間違ってなくても

裁判では負ける事がありますので

裁判を過剰に信頼するのは危険

って事です。

正しいと思って裁判に訴えても負ける事がある

どうすれば良いでしょうね？

まぁ結論から言えば

裁判になるような事はしない

これが一番でしょうね。

私の身近な人間で

昔柔道で金メダルと取って

その後強姦罪で懲役刑になった有名人と親しい人がいますが

彼曰く

あの裁判は冤罪だそうですね。

つまり被害者との間では合意してた

だから強姦では無い

って事です。

まぁ実際に冤罪かどうかは知る由もありませんが

ただ

仮にそうだとしても

結婚してるにも関わらず教え子との性行為はあった訳で

世間的には同情する声はあまり聞こえてきませんでしたよね。

つまり

私たちが生きてる社会は

法治国家ですが

裁判だけで善悪が決まる訳ではありません

人間の持つ感情

これは時には裁判より上に存在するのです。

ですから言いたいことは

欠陥だらけの裁判に勝つかどうか？

そればかりに支配されては

いずれその被害に遭うことがある

って事です。

それよりも一番自分の身を守るのは

裁判では無く自分の良心に従って生きる

って事です。

まぁしかし身は守れますが

つまらない人生でもありますね。

私自身裁判で訴えられた事も

警察に調べられた事もありませんが

良く人から

“何を楽しみに生きてるの”

って言われます。

ただ

周りからはそんな評価かも知れませんが

私自身は

社員と家族の生活を守る

この使命を果たすのが人生の最優先課題ですから

他の人が味わう事のない満足感

これは常に存在します。

そして私にとっては

その喜びに比べればそれ以外の快楽は

大した価値が無いのです。

一見つまらないように見えても

本人にとって達成感は大きいのです。

Recently, NHK aired a documentary program on forensic medicine, 

and I was quite surprised.

According to the doctors of forensic medicine,

except for cases where there is obvious trauma,

in reality, even if an autopsy is performed, it is almost impossible to determine the cause of death,

and the estimated time of death is unreliable.

However, that doesn't mean forensic medicine is unnecessary.

As the name forensic medicine suggests, even if it is uncertain, it is necessary in court

I was shocked by what the forensic medicine doctor said when he was interviewed.

The courtroom is supposed to be a place of justice, 

but in reality, the only thing both the prosecution and the defense think about is winning the case.

So, even if the autopsy results are uncertain, they will interpret them in a way that is convenient for both sides and try to win the case.

But, this is inevitable, I guess.

Each side goes to court to get their own argument, and it doesn't matter whether this is actually correct or not.

So, there are many wrong judges , and there are also many cases of serious crimes being overlooked.

This is the reality of courts. 

This is something we, the general public, should keep in mind.

In other words, if forensic science is unreliable,

it is possible that trials based on it will make wrong verdict.

even if you' are not wrong

you can lose in court, so it's dangerous to trust the court too much.

What should we do ?

it's probably best not to do anything that could lead to a court case.

I have a friend who is close to a famous person who won a gold medal in judo a long time ago and he was later sentenced to prison for rape, 

and he said

that trial was a false accusation.

In other words, there was consent between him and the victim,

so it wasn't rape.

Well, there's no way to know if it was actually a false accusation,

but even if it was,

he had sex with his student despite being married, 

so there wasn't much sympathy from the public.

In other words,

we live in a society governed by laws, but justice alone does not determine right and wrong. Human emotions sometimes exist above justice. 

So what I want to say is, 

will you win a flawed trial? 

If you are controlled by that, 

you will eventually become a victim. 

The best way to protect yourself is to live according to your conscience, not the courts. 

Well, you can protect yourself, 

but it can also be a boring life.

 I have never been sued in court or investigated by the police, 

but people often ask me, 

"What are you looking forward to in life?" 

However, while that may be what others think, 

for me, fulfilling my mission to protect the lives of my employees and their families is my top priority in life, 

so there is always a satisfaction that no one else can experience. 

And for me, other pleasures are not worth much compared to that joy.

 Even if it seems boring at first glance, 

it is a great sense of accomplishment for me.
