U.S. reaches agreement in Philadelphia bullying case

A year after more than two dozen Asian American students were attacked at a high school in South Philadelphia, the Justice Department has reached an agreement with school officials there, resolving a high-profile investigation into school bullying.

The Philadelphia incident, which involved a day-long assault on the students and sent 13 to the hospital, was one of several glaring cases of school harassment across the country last year. The attack made international news when it triggered an eight-day boycott by Asian American students, many of them recent immigrants, who said they would not return to school until they felt safe.

Justice Department officials signaled that the agreement with the School District of Philadelphia, which requires the district to hire a consultant focused on preventing harassment and discrimination, will serve as a nationwide standard for school systems trying to prevent bullying. Student-on-student harassment is an increasing problem and makes up a growing portion of the cases under investigation by Justice.

Fights spurred by racial tensions have diminished at Pinole Valley High since 2008, when a noose was found hanging from a tree, teachers say.
Students, teachers and others have worked hard to foster tolerance.
The campus has partnered with the Anti-Defamation League to strengthen awareness of student differences through community workshops and diversity training for staff and students.
"Year after year, our campus gets more diverse, yet has become more tolerant," said Dayna Dibble, a Pinole Valley High leadership teacher. "We have a lot less physical violence -- especially based on race -- than three or four years ago. We went through a fairly bad period with gang fights."
The West Contra Costa school district is encouraging schools such as Pinole Valley to continue working to ensure that students feel safe expressing themselves on campus, Dibble said.
Recent news stories of gay students committing suicide after being bullied or cyberbullied have heightened awareness of the need to address prejudice among teens to prevent such tragedies.
Roughly one-third of students ages 12 to 18 reported they were bullied at school, according to a national report. And about 20 percent of teens engage in cyberbulling or are cyberbullied, but only a fraction of them tell adults, said Nina Grotch, education director for the Anti-Defamation League.

I was bullied in school because I was fat; my husband was picked on because he was skinny. There is no winning with bullies. Bullies bully because they can; whether on the playground, being the school, in the home, at the bus stop, at church, on Facebook, Twitter, Youtube. Bullying of any child or adult for any reason is an intolerable act.

DOUGLASS (Mont.) ― After more than a month-long investigation, police have determined the suicide death of Boyertown Area High School junior Jesse Buchsbaum was not caused by bullying.

Buchsbaum, 17, took his life Oct. 25, and his parents believed the death was attributed to bullying because their son suffered from a disability.

Detective Dirk R. Boughter, of the Douglass (Mont.) Police Department, said Wednesday the purpose of the investigation was to gather evidence as to why Buchsbaum committed suicide.

In the department's investigation, police collected physical evidence, computer forensics and interviewed people who knew Buchsbaum.

After that investigation, police were unable find a reason as to why Buchsbaum took his life.

(NECN) - Suicide is reportedly the third leading cause of death for young people between 15 and 24. It's a disturbing trend that's made a lot of headlines this year.

This Thursday, December 23, more than a thousand local high school and college students will rally to raise awareness about teen suicide and the bullying that has often led to it.

Development coordinator of Samaritans, Karina Carley and UMass -Amherst freshman and Samariteens volunteer Nick Galatis joined us to talk about the link between bullying and suicide.

Carley says teens deal with a lot of stress on a regular basis that makes growing up a difficult time.

Where was the outcry for the kids who were bullied because of their handicap, mental capacity, looks and even their income? Where was the media attention when they became the target? Many kids committed suicide or tried to due to the hardship of being bullied. The media, to me, is linking being gay to bullying. Bullying does not hit just one specific group. Bullying is across the board and it is getting worse due to phone cameras and the Internet. Where is the privacy issue?

The impact of being bullied has a far reaching effect on the person's life and, sad to say, many of the school administrators don't want to get involved, are too inept, or friends with the parents of the bully.

Why can I write this letter? Because I dealt with the West Virginia school system, a principal and a staff. Their response: "They are just being kids." It was an annual school party to welcome all newcomers. Thank you for the support you gave when the bullying left my child in the darkest area, all alone, in tears. It was his friends that tried to stop the bullying. Not one teacher, not one school administrator came to his aid or tried to stop it. Their lack of a decent response to resolve the issue sent a very clear message not only to me but to those who do harm on another.

What of our West Virginia legislators and Capito? Their response were the same as the teachers. So sad our tax dollars paid and still pay these people. Pathetic.

いじめを受けた子どもが自殺する問題が相次いだことを受けて、文部科学省は、いじめや子どもの自殺への対応をテーマに、教師や教育委員会の関係者を対象にした初めての研修会を開きました。
文部科学省で開かれた研修会には、関東地方の各地から教師や教育委員会の関係者などおよそ２００人が出席しました。ことし１０月、群馬県桐生市でいじめを受けていた小学６年生の女の子が自殺した問題では、学校側が十分な対策を取っていなかったことが明らかになりました。研修会ではこうした事例を参考に、いじめの問題には担任の教師だけでなく校長を中心に学校全体で対応することや、日頃から子どもに話を聞いたりアンケート調査をしたりして、いじめの兆候をいち早くつかむことの重要性を確認しました。また文部科学省の担当者は、子どもからいじめの訴えがあった場合は、事実関係の確認を行って保護者に十分説明することが必要だと説明しました。文部科学省児童生徒課の磯谷桂介課長は「いじめはどの学校にも起こりうるという認識を持ち、問題が起きた場合に、隠そうとせずに、保護者や、スクールカウンセラーなどの専門家と連携しながら、対応に当たってもらいたい」と話していました。

　２２日午前９時ごろ、札幌市中央区南１８西１６の自宅があるマンション駐車場で、北海道警札幌南署員らが市立伏見中２年の女子生徒（１３）が倒れているのを見つけた。生徒は病院で死亡が確認された。同署によると、女子生徒はいじめをほのめかす遺書を自宅居間に残しており、自宅があるマンション６階から飛び降り自殺したとみられる。

　伏見中によると、女子生徒の遺書には「１年生のとき無視されたり『キモイ』と言われた」「学校のスピーチが嫌だ」といった趣旨の言葉が書かれていたという。同日夜に記者会見した鈴木文夫校長は「大変痛ましく重く考えている」と謝罪したうえで、いじめの有無については「いじめが原因だとも考えられるので、調査したい」と話した。

　自殺が報じられるとその後に自殺が増える現象を「ウェルテル効果」と呼ぶ。ゲーテの「若きウェルテルの悩み」（1774年）は、失恋した主人公が最後に銃で自殺するお話だが、出版後に同じ手法の自殺が相次ぎ、発禁にした地域があった。それにちなんで米国の社会学者が名付けた。　いまどき小説やドラマの中の自殺が現実の自殺を増やす傾向は見られないらしい。だが、自殺のニュースが自殺を誘発する現象は世界各地にある。とくに青少年に対する影響は大きいという

○いじめというのはどこにもあり、その要因はさまざま。
○いじめが自殺につながるケースもあるが、自殺でもいじめが原因とも限らない
○いじめによる自殺の報道があると、
　　いじめた、と言われる側がこんどは世間からいじめられることもあり、

　　自殺志願予備軍の他の自発を誘導してしまうことがある。
○学校はいじめを軽視あるいは隠蔽しがちである。
○積極的に対処するといじめは減少する。
○メディアはいじめ報道を特に、隠蔽していない。
　もっとも、
○もっと、学校・社会・メディアが関心をもつべきである。


こうしたことはほぼ共通するのであって、文化論にはしることなくそれを前提に論じればもっと建設的なものになる、と思う。

In early December Rafal Gorski returned to his home country, Poland, planning never to return to Scotland.

The racist insults and harassments, the taunts of “F***ing Polish – go back to Poland”, threats of violence and attacks on his family home were so bad he couldn’t deal with the stress of life here anymore. He feared that he’d suffer the same fate as a friend – killed in a stabbing in Glasgow by a man who afterwards boasted that he’d taken the life of a “daft Pole”.

The real name and identity of the Gorskis has been changed as a neighbour, who allegedly took part in the abuse of the Polish family, has just been charged with racially aggravated offences and is now on bail, forbidden from contacting the Gorskis or entering the street where they live. Gorski’s wife, Ilona, remains in Scotland, scared to go out on her own, but committed to staying as she wants her teenage son, Jakub, to complete his education in Scotland.

The neighbours who abused her called her a “Polish dog” and told her they would “send her family back to Poland in a box”. Jakub always checks to see if there is anyone in the street before he leaves the house.

The Gorskis are not alone. Poles and other Eastern Europeans are experiencing a rising tide of racist abuse and violence. The Federation of Poles in Great Britain says there has been an annual 20% rise in racist incidents.

Students rally for classmate facing deportation to Mexico

TORONTO Daniel Garcia was supposed to spend Christmas with his girlfriend and her family, even staying overnight at their home so he wouldn’t be alone on the holidays.

Instead, the 18-year-old Toronto student has spent the past few days in an immigration detention centre after police arrested him Thursday night, according to his friends.

Many said they worry Garcia will be quietly deported during the holidays, before he has a chance to appeal the decision.

The government “has a nasty habit of enforcing deportation orders around Christmas time when they know people can’t access the courts,” said Karin Baqi, a lawyer who has spoken to Garcia since his arrest.

Garcia, a student at Parkdale Collegiate Institute, arrived from Mexico with his sister in 2007. Both filed for refugee status, saying they faced persecution and death in their homeland.

The refugee claim was rejected and Garcia submitted an application for a pre-removal risk assessment, which evaluates the danger the person will face if deported.

Garcia said in a statement he hadn’t received a decision on the application when he was stopped by police and turned over to immigration officers Thursday.

Concerns of racism in the Green Mountain State

My eyes burn with shame as I read of the U.S. Civil Rights Commission firing and excoriation of Curtiss Reed, Jr., as a member of their Vermont State Advisory Commission.
I have known and worked with Curtiss Reed off and on for nearly two decades. He has the highest personal integrity. He is in every way qualified to represent our state in the crucial federally focused work of civil rights and anti-racism. He brings to the job the very highest standards and sensibilities for professionalism and knowledge of the subject. He has been carrying high the banner of civil and human rights against racism for as long as I have known him.
In his Oct. 18 op-ed in the Brattleboro Reformer, Curtiss was merely taking the care to present logically and accurately the case for anti-racism in our state, portraying it as the issue of life and death importance that it is.
Curtiss was accurate, in my opinion, when he said the Republican slogan "Pure Vermont" was racist. Moreover, as a member of a persecuted minority in our state, he has the perfect right to relate his own narrative interpretation of current events to the public. As a campaign slogan, it is most inappropriate. It is a tacit and hidden appeal to racism, even if it is not consciously meant as such.
Curtiss was right to refer to the State's early 20th century "eugenics" campaigns, codified under law as "voluntary sterilization," to wipe out Abenaki bloodlines. Because of　the systematic and structural crimes committed in our state against people of color and other religions and ethnic backgrounds, Curtiss was correct in making the references he did. He did not compare the scope of these crimes to the Holocaust or to the Khmer Rouge "killing fields," but averred that the notion of "purity" raises the specter behind such occurrences.

Integrating students with disabilities in German schools still a battle

For German children with disabilities it's always been difficult to get regular schools to allow them to attend. Now, however, things must change because of a UN convention requiring schools to accept all children.

When Marcel was old enough to start school, his mother picked out one of the public elementary schools in their neighborhood for him. The school, however, said he couldn't attend. Why? They said they weren't set up to deal with a kid in a wheelchair.

For decades that's the way it was in Germany. Children with disabilities were sent to separate schools, each one specialized for a different disability. That is all set to change now that Germany has ratified a United Nations resolution that says that all children with disabilities have a right to be educated at a regular school.

It's set to be a long process. Currently the majority of German children with disabilities don't go to regular schools. So far the city-state of Bremen is the only German state to open all its schools to everyone. In North Rhine-Westphalia, where Marcel lives, that could be a long way off, although he did eventually find a spot in what is called an integrated or inclusive school.

Compared with a 40 per cent arrest rate for sex crimes among civilians, only eight per cent of investigated cases in the military lead to prosecution.

After Congress mandated it do so in 2006, the Pentagon started a comprehensive programme to track incidents. That year, there were 2,974 reported cases of rape and sexual assault in the military. Of these, only 292 cases resulted in trials, and those netted only 181 prosecutions of perpetrators.


Faced with the threat of possible persecution and losing their jobs and professional credibility, most soldiers prefer to remain silent about their traumas. Not that silence helps, because records reveal that less than one-third of the women have been able to maintain their careers in the military after having been assaulted.


"The people I work with go all the way back to WWII. The stories are almost exactly the same. It has always been covered up. Still the drill sergeants, chaplains, and doctors appear to be the worst perpetrators. So when these guys are convicted, rather than punishing to the fullest extent, they can give them a letter of reprimand which means Tommy was bad, signed The Commander. That letter comes out of his personnel file before he moves on to the next unit, so it’s like nothing happened."

LOS ANGELES (CBS) We are outraged when a legal "technicality" frees a guilty person from prosecution and prison, but what about when a "technicality" is used as an excuse to put a person IN prison? As crazy as that sounds, the California Attorney General hopes to do just that to a 45-year-old man by the name of Bruce Lisker.
Last year, Lisker was released after spending 26 years in prison for the murder of his mother. Lisker's release came after a federal judge ruled that the evidence used to convict him was either questionable or utterly false.

　親友は男子学生が自殺を図った後、「もっと彼を守ってあげることができればよかったと悩み苦しんだ」と話している。
　当時３年だった男子学生は平成１９年６月、神戸市の自宅マンションから飛び降り自殺。遺書やメールには大学でのいじめを強く示唆する文面が記されており、遺族は調査を要望したが、大学側は３年以上放置。このため、遺族は今年８月、大阪弁護士会に人権救済を申し立てていた。
　大学側は産経新聞の報道を受けた８月の記者会見で、いじめの事実を強く否定したが、１０月に弁護士らでつくる第三者委員会を設置し、自殺の原因などを調査しており、２７日に記者会見を開き、調査結果を公表する予定。
　この問題をめぐっては、男子学生のゼミ担当教授が産経新聞の取材に対し、「大学はいじめ自殺の可能性が高いことを把握しながら調査せず隠蔽（いんぺい）した」と証言している

　まだ、報道は産経だけのようだが、また、いじめによる自殺であり、外国人が被害者である。

　ご冥福をお祈りする。

　教育機関の怠慢、あるいは、責任逃れについてもっと追求されて然るべきであろう。

　追手門学院大学（大阪府茨木市）に通っていた在日インド人の男子学生（当時２０）が２００７年、いじめを受けたなどとする遺書を残して自殺した問題で、大学が設けた第三者委員会（委員長・宮崎裕二弁護士）は２７日、「自殺の原因としていじめの存在を否定できない」とする報告書を公表した。

　同委員会は今年１０月以降、男子学生が所属していた経営学部マーケティング科の担当教員や学生ら約２０人から事情を聴き、男子学生が他の学生にズボンを脱がされたり、花火を向けられたりしていたという間接的証言を得た。また、遺書に「学校で受け続けたイジメ」とあることを重く見て、「いじめの具体的事実を特定することはできないが、いじめが存在したことは推定される」と結論づけたという。

　同大学の落合正行学長は「前途ある学生の自死を未然に防げなかったこと、誠に申し訳ありませんでした」と陳謝。大学は再発防止策として、人権啓発講座の充実やいじめの相談窓口の一本化などに取り組み、理事長ら幹部８人を処分する方針という。

　学生の父親は０８年、「息子に会いに行く」と言って、同じマンションから飛び降り、自殺した。母親は「大学はいじめを隠してきたと思う。いじめがなかったら息子が亡くなることはなかったし、大学が素早く調査してきちんと対応してくれたら、お父さんも後を追うことはなかった」とのコメントを出した。

　学生の遺族は、大学から見舞金を受け取り、相互に何らの債権債務がないことを確認したという合意書を交わしている。しかし、遺族は、合意書を交わしたために自殺の原因調査を大学に請求する権利を侵害されたとして、大阪弁護士会に人権救済を申し立てている。
