・ 望月蓮(仮名)…子どもを元妻に連れていかれ1年半以上の調停後に親権を譲る。養子縁組前後に面会交流が不履行になり現在調停中。相手方は接見禁止を申し立てている。
・ 鵜飼恵子…4歳半の娘をイランに連れていかれ、約2年間イランで同居。昨年11月に再会するまで2年間娘と離別。

「国際社会から見た日本の現状―親による子の連れ去りと面会拒否」

別居によって子どもを連れていった親がそのまま親権を確保し離婚が成立。子どもを連れていかれた親に会わせないということは、日本では珍しくありません。
ところが、離婚後も双方の親が子どもの養育を引き続き行なうことが可能な法制度(共同親権・共同監護)の国では、他方の親の同意のない子の連れ去りは犯罪となりえます。
「どうして会わせてもらえないの」という問いかけは、会わせてもらえないほうに原因があるという先入観から発せられます。しかし、親どうしの関係と親子関係を分けて考えなければ、離婚に伴う親どうしの対立で、親と会えなくなるという不利益を被るのは子どもです。
離婚すれば一方の親が子どもを見ればいいという離婚後の単独親権制度を支えてきた考え方は、離婚して同居親が子どもの面会を拒否すれば、親子が会う手立てが、法的にも事実上も用意されていないという現状を肯定するものでしかありません。
こういった日本の現状は、離婚後も親子の行き来が日本よりもはるかに保障されている海外から見れば、とても遅れて見えるようです。成人する子どもの4人に1人が親の離婚を経験する今日、国際社会から見た日本の法制度と司法制度の現状を指摘し、法整備の必要性を考えてみたいと思います。

Speech from left-behind parents
Ren Mochizuki---His child was removed and kept by his ex-wife. After his wife registered his child under her new husband’s family registry, Mochizuki has been denied all access to his child. His wife filed for a restraining order.
Keiko Ukai---Her Iranian husband took her 4 year-old-daughter to Iran without Ukai’s consent. She followed her daughter and lived in Iran for about two yeas. Ukai could not bring her daughter back to Japan, but reunited with her last November after a two-year separation.

In Japan, it is common that a parent who takes her or his children away first gets custody, and then denies visitation rights of the other parent.
On the contrary, taking children away without the other parent’s consent is a crime in other countries where the legal systems allow separated parents to share parenting of their children (joint custody or co-parenting system.)
“Why are you forbidden to see your child?”---People ask left behind parents such a question, because they assume that the estranged parents are responsible for this situation. Yet, instead of blaming who is responsible for the separation, the children’s best interest should be considered first. We have to separate the issue of parents and children from that of couples.
An idea that has supported a sole custody system after divorce only justifies the Japanese legal system failing to enforce the visitation rights.
The Japanese custody system is far behind other countries where the legal presumption is for joint custody after divorce. Since, every one of four children in Japan experience their parents’ divorce today, we need to understand how the Japanese divorce system is problematic and to discuss the importance of establishing a better legal system.
