水原一平のニュースが流れてきますが
アメリカと日本の司法の実態は全く違う
これが伝わってきます。
水原一平はあれだけの大金を盗んでおきながら
逮捕されませんでしたし
出頭してもすぐに保釈金を払って
結局拘束される事はありませんでした。
保釈金も25000ドルだそうですから
盗んだ金額と比べれば
本当に僅かです。
これが日本であれば
もちろんすぐに逮捕されて
起訴されて判決まで拘留される事になりますが
アメリカはその意味では寛大
そう感じますね。
どうしてでしょうね？
私が思うに日本の場合
刑事訴訟法が欧米の真似をしてるために
日本の実態に合わないんでしょうね。
法の原則は
推定無罪
これは日本もアメリカも同じです。
だから水原一平も判決が出るまでは寛大に扱われます。
ところがこの推定無罪の考え方は
日本の国民感情と乖離してるんでしょうね。
悪い奴に人権なんか無い
そんな思いが日本人には強い
だから何十億も盗んだ男を
逮捕しない
なんて事では国民が許さない
これが
アメリカと日本の司法の違いの原因
そう思いますね。
何でそんな違いが生まれるのか不思議ですよね。
日本は犯罪者に厳しくて
アメリカは寛大
キリスト教が影響してるのでしょうか？
まぁそれもあるかも知れませんが
多分地理的条件の違いが大きいんだと思いますね。
日本は島国ですから
犯罪者に寛大になれば内部の秩序が守れませんから
昔から重罪は獄門晒し首
みたいな厳罰で犯罪を抑止してきたのだと思います。
それに比べてアメリカは
広大で多民族国家ですから
社会全体の秩序を個人の厳罰だけでは守れなかったんでしょうね。
西部劇を見ると
綺麗な女性が銃を持って悪い奴に対峙する
そんなシーンがありますが
自分の事は自分で守る
これを基本に国づくりをするしか無かったんだと思います。
そうやって考えると
ウクライナの戦争も良く理解できます。
日本人は自由とか民主主義
この理念を守る戦い
だから国際社会は一致してウクライナを支えるべき
こう考えていますが
どうやらアメリカは
自分で自分を守れないなら諦めろ
みたいな人がたくさんいるんでしょうね。
だからウクライナ支援法案は下院で宙に浮いたまま
って訳です。
アメリカ人もたくさんウクライナを支援するべき
そう思ってる人はいますが
そんな人たちも日本人のように
国際秩序を守る意識は弱い
これも色んな人の話から伝わってきます
では何のためにウクライナを助けるか？
って言うと
ウクライナが負ければ
次はNATO加盟国のバルト三国だのポーランドだのが
ロシアのターゲットになりますから
そうなればアメリカも加盟国の義務を果たさなけれならないので
自国の兵士の命も失い
お金もたくさんかかる
だからウクライナで食い止めた方が安上がり
これが理屈です。
日本人からすれば
いやいや国際秩序が大事だろう
って思いますが
どうやらアメリカ人の本音はあくまで損得勘定のようです。
まぁしかし日本も軍事援助はできない訳ですからね
それをどうこう言う資格もありません。
ただ思うのは
グローバル化とは色んな意味がありますが
日本人の地理的な条件から生まれた秩序のための意識
これが欧米に合わせて大きく崩れて行きますね。
最近は営業マンがＴシャツでやってきたり
髪型も後ろで束ねたり
なんて人も増えました
お客様も同性のカップルが堂々とやってきます。
古い人間には違和感がありますが
この流れは止めようもありませんので
じっと口を閉じて
言葉を飲み込むだけです。
