Earlier this month, Russian lawmakers suggested preparing a list of Americans who have violated the rights of Russian children adopted into US families. They said they will name their law after Dima Yakovlev – a two-year-old boy who died after being locked in a car by his adoptive father on a hot day in 2008. But the law might see a broader application since the draft has officially been named “Enforcement actions on people involved in violating human rights of Russian Federation citizens”.
The move comes in response to a US list of sanctions, the so-called Magnitsky list, which is expected to be signed into law by the end of the week. The act imposes visa bans and asset freezes on Russian officials allegedly involved in the death of Russian anti-corruption lawyer Sergey Magnitsky and in other human rights abuses in the country. The 37-year-old died in a Moscow pre-trial detention center in November 2009.
The Russian President believes that the American Magnitsky law is most likely the result of internal political wrangling in the US.
“But I don’t understand why Russian-US relations are sacrificed for the sake of domestic policies,” Putin noted on Thursday. Washington speaks about the ‘reset’ and, at the same time, aggravates the situation, he added.

The President noted that American jails also see their prisoners die.
“Why, don’t people die in their prisons as well? Perhaps, even more than in ours,” he said.
Despite promises by the US leadership, the Guantanamo Bay detention camp is still operating.
“People are kept there without trial – in shackles and chains just like in the Middle Ages,” Putin remarked and now, he continued, people “who opened secret prisons and legalized torture during investigations” point out Russia's shortcomings.
As for the death of Magnitsky, Putin expressed his regret for the tragedy, but noted that the investigation into the case is not over and it is yet to be found who is to blame for the incident.

As the meeting gradually switched to the problem of Russian orphans dying in foreign foster families, Putin slammed American authorities for their slack reaction of the incidents.
"We are indignant not so much at these tragedies – even though it’s the worst thing that can happen – as at the reaction of the [US] government, a vindicatory reaction. That’s what is bad,” Vladimir Putin said on Thursday.
American judicial authorities hardly respond to cases of abuse of Russian children by their American adoptive parents, the Russian President stated. On the contrary, US courts justify such crimes and acquit those guilty of charges against them, Putin added.
Moscow has repeatedly criticized the US for applying “double standards” in dealing with Russian child abuse cases.
Russian officials claim that at least 19 Russian children have been killed by their foster parents in the US since the early 1990s, when adoption began.

Why Germany Can't Shed Its Troubling Past

The 2006 World Cup in Germany seemed like a fairy tale come true for the country. Suddenly, years of troubling history seemed to lift amidst euphoria over the cosmopolitan twist fate had brought to the country. But this year, amid fresh debates over xenophobia, many are left wondering if the ugly German is back.

Now we seem ugly again. When the Greeks or the Spaniards protest against the supposed dictate of the Germans in euro policy, some of their posters depict Nazi motifs. When America author Tuvia Tenenbom recently traveled through Germany, he discovered plenty of anti-Semitism. His book, recently published in German, has triggered an intense discussion. We're back where we didn't want to be, caught in the spell of a Nazi past, one that also dominates the present.
But we don't even need the opinions of others to bring us to this conclusion. What were our big issues in 2012?

In April, author Günter Grass wrote a poem that was so sharply critical of Israel that the Nobel laureate came under the suspicion of being anti-Semitic. A few members of the Pirate Party sounded so naïve when they talked about the Nazis as to create the impression that they had understood nothing about Germany's past. Germans spent half the summer debating whether Nadja Drygalla, whose boyfriend was a member of a neo-Nazi group, should be allowed to compete in the London Olympics as part of the German women's rowing eight team. The other half of the summer was dominated by the debate over whether a Russian opera singer with a swastika tattoo should be allowed to sing at the Bayreuth Festival. In late August, several media organizations, including SPIEGEL, reported that neo-Nazis had infiltrated a neighborhood in the western German city of Dortmund, and that they had even established a presence in the fan section of the city's football club, Borussia Dortmund.

Throughout the year, we read news reports on the upcoming trial of a presumed member and supporter of the National Socialist Underground (NSU), a far-right terrorist group believed responsible for the murder of nine men of immigrant origin and a policewoman. Many of the reports addressed mistakes made by the authorities. Another ongoing story was the question of whether the interior ministers of the German states plan to launch a new case to ban the far-right National Democratic Party (NPD).

The scandal isn't that Nadja Drygalla was part of the German rowing team. The scandal is that young Germans in the 21st century feel the need to be neo-Nazis. The scandal is that neo-Nazis now dominate a neighborhood in the Ruhr region, a region that, ironically enough, was long proud of its capacity to integrate different ethnic groups. The scandal is that for years a terrorist group was able to pass undetected as it shot and killed people from immigrant communities, and that some public servants couldn't or wouldn't see what monstrosities were taking place in Germany.

Does it happen elsewhere? Of course it does. Other countries, like Hungary, the Netherlands, France and Denmark, even have radical right-wing parties represented in their national parliaments. Does that mean it isn't really all that bad in Germany? No, it is. Even after almost 70 years, it does make a difference whether an act of xenophobia happens in Germany or in Spain. We remain a special case, because Hitler is one of us.

北朝鮮から覚醒剤密輸、元暴力団組長らに逆転無罪

　北朝鮮から大量の覚醒剤を密輸したとして、覚醒剤取締法違反などの罪に問われた元暴力団組長宮田克彦被告（６５）と韓国籍の禹（ウ）時允被告（６５）の控訴審判決が１４日、東京高裁であった。八木正一裁判長は、２人を無期懲役、追徴金約９億６１００万円などとした一審・東京地裁判決を破棄し、逆転無罪とした。

　八木裁判長は「２人の関与を認めた共犯者の供述は信用できない」と述べた。

　２００８年５月の一審判決は、２人が数人の共犯者と共謀して０２年、北朝鮮から覚醒剤計約２３０キロを貨物船で運んで島根県沖の日本海に投下し、密輸したなどと認定。宮田被告を「大規模な組織的犯行の首謀者」、禹被告を「北朝鮮との連絡役」だと判断していた。

最近、多いね、逆転無罪。

　中国江蘇省南京市の「南京大虐殺記念館」で１３日、虐殺から７５年の追悼式典を取材していた共同通信記者が、式典に参加していた中国人に蹴られるなどの暴行を受けた。痛みがあるが、外傷はない。

　記者が携行していたパソコンで記事を執筆していた際、突然、背後から２０代とみられる男に腰を蹴られた。さらに、そばにいた中年の男が「おまえは日本人か」と叫び、記者が身に着けていたマフラーを引っ張り、一時、首を圧迫した。

　周辺にいた私服警官が男らを取り押さえたが、連行はしなかったとみられる。当時、式典の正式行事は終わり、敷地内で参加者が「平和の鐘」をつくなどしていた。（共同）

中国でも、こうした行為は恥ずかしい、といった報道はあるのであろうか？

産経の記事*は私も注目していた。

発射が近いとの情報を踏まえ、野田佳彦首相は発射予告期間に入ってから３日目のこの日も午前７時前に官邸入り。８時から関係閣僚会議を開き、首相は「最高度の緊張感を持って現態勢を維持する」と警戒を継続するよう指示した。

　その場で「近日中の発射の可能性」に関する情報を共有し、午前１１時の藤村修官房長官の定例記者会見で国民に注意を国民に促すとの対処方針を立てていたが、北朝鮮がミサイルを発射したのは、この１時間余り後の９時４９分。

仮に日本が情報をもとに警戒し、韓国が不意打ちだったとすれば、韓国には情報が遮断された可能性はある。

、複数の政府高官によると、米政府はいったん撤去して以降の新たな情報は日本側に伝えるだけで韓国ルートは遮断したとされる。ある高官は「分別なく韓国から情報が漏れることに業を煮やし制裁を科した」と指摘する。

同じく、右派系統の情報であるが、

①北のミサイル発射について、福山・元陸将に電話で話を聞いた。ａ）北がフェイントをかけたという見方と、ｂ）韓国の情報筋が情報の分析を間違えたという説と、ｃ）北が日米韓の連携を試したといううがった見方の三つがあるようだ。ｃ）はあり得ない。なぜならそんなことをしなくても、韓国の情報関連の部局の内部に北の工作員が深く浸透していて、情報は北に筒抜けだと福山氏。どうやら、ｂ）が有力らしい。、

とも言われている。


どうなんだろうね。


舞鶴殺害無罪　検察に厳格な立証求めた判決

「疑わしきは被告の利益に」という刑事裁判の原則に沿った判断を示したと言えよう。

　被告は一貫して犯行を否認した。凶器や指紋などの直接証拠も見つからなかった。

　このため、検察は、被告と被害者によく似た男女が一緒にいたとする目撃証言を柱に、状況証拠を積み重ねて立件した。

　しかし、判決は、目撃証言について、見過ごせない変遷があるとして信用性を否定した。

　最高裁は一昨年４月、大阪の母子殺害事件の判決の中で、状況証拠だけで有罪認定するには「犯人でなければ説明のつかない証拠が必要」との判断基準を示した。

　今回、検察が提示した状況証拠は、この基準を満たせなかったのだろう。捜査当局は、広範な証拠収集と厳格な立証を求めた判決を重く受け止めねばならない。

こういうのってのは、ＢＢＣやＮＹＴは取り上げないだろうねーーーセンセーショナルじゃないし。

　ある黒人少年院でのリンチの歴史


　で、日本でも関東大震災での朝鮮人虐殺事件とか知らない人もいるし、現在でもある、朝鮮人、女性、ゲイなどの少数弱者に対する差別行動、迫害行動について、中流階級の一般人は関心がない場合多い。

　それと同様に、アメリカ人の一般人は、自国の少数弱者の迫害の歴史や現実に関して驚くほどうとい。

　ところが、無知であるくせに、アメリカ人でも、日本人でも欧米は進んでいる、日本は遅れているという先入観があるために、事実をチェックするまえに、日本の人権状況は特に悪いなどと結論づけてしまう。

　日本に人種差別がある、という主張と、日本の人種差別の状況は他国に比べて特にひどい、という主張は異なる二つの主張であり、前者はその通りだが、後者はそうとはいえない。そして、皮肉なことに、後者は往々にして、一種の人種差別的偏見からの結論であることに注意すべきである。

my answer to the question "where are you from?" never seemed to fully satisfy some people and instead they'd say "no, I mean where are you from?" usually accompanied by a pointed loo

"Where are you from?" "Cardiff." "Oh … yeah … um." It's a conversation I've had countless times. I normally end up explaining that my dad is from Mauritius. But most of the time, it's a deliberate answer from me when I know the real question: "How come you're brown?"

And I remember at the age of 11, on the outskirts of Dublin visiting my grandmother's family and being assaulted by a group of youths who said that "Ballyfermot is a white man's town"

So for the record, may I set the following straight: I am from London. Asking "Yes, but where are you from?" generally doesn't come across well

I grew up as a Bombay Brummie blend, in a predominantly pale-skinned farming town. Lots of gossipy elderly ladies with shopping baskets. "Fit in" and "be invisible" were my parents' mantras

My parents hid in the shadows – I wanted to be out in the sunshine, head held high. It was always the prejudiced people's problem, not mine. But part of me will always be angry, with stupidity, with blind assumption. Much later, loving my heritage, I called my daughter "India".

日本でもハーフは様々な問題を抱えているが、しかし、イギリスも同じ。

ともに問題に対処していきましょうというならいいが、しかし、イギリスが進歩しているなどという優越意識は、明らかに無知と高慢による人種差別、文化差別意識に基づいている。

日本の場合、対立といえるのは、共産・社民を中心とした主張と、自民、公明、民主、維新かな？

　安倍さんが総理になりそうなわけだが、以前と同じで、It's the economy, stupid で、経済問題を最優先すべし。そして、歴史問題に関わるな、ということ。
特に慰安婦問題では、河野談話を弄ろうなど考えるな、ということ。
慰安婦問題に関しては、前回、安倍氏のアプローチは失敗したわけだ。旧日本軍のように馬鹿の一つ覚えの失敗した戦術はとっていはいけない。なにかするなら、新しいアプローチをすべきである。

私はやるなら、

　　日米韓が共通の基準で、各国が迫害した戦時性奴隷に関する救済を共同宣言する、

するようにもっていくのがいいと思う。

靖国参拝では、右翼が堂々とやれ、と言っているようであるが、前回の眼くらましで正解であった、と思う。うまくいったのは繰り返すべし。

竹島・尖閣は、前者は国際司法裁判所に提訴、後者も、国際司法裁判所に提訴するように中国に提言するのがいいと思う。


ただ、それよりなにより、経済と少子高齢化問題、それに付随する社会保障改革を最重要課題として頑張ってもらいたい。マスコミも自分たちの考える最重要課題をつねに念頭において報道してもらいたいものだ。

　発射前日の「撤去」情報は何だったのか－。北朝鮮の「人工衛星」と称する長距離弾道ミサイルの発射は国民にとって「寝耳に水」との感が強いが、水面下では日本政府は「発射近し」との情報を得ていた。一方、「ミサイルを発射台から一時撤去」とみていた韓国政府には、米政府が不信感から詳細な衛星情報を提供していなかったという。

　「近日中（の発射）はなさそうだとの報道が流れていた。警戒レベルを下げなかったのはさまざまなインテリジェンス（機密情報）によるものだ」

　玄葉光一郎外相は１２日の記者会見で、情報を遮断された韓国とは異なり、日本政府には米側から時々刻々と発射施設の動きが伝わっていたことを示唆した。

　ミサイルの探知・迎撃にあたる自衛隊幹部も「１２日の発射はあり得ると身構えていた」と振り返る。

　森本敏防衛相は同日の記者会見で「据え置かれていたもの（ミサイル）が取り外されたことは確認している」と説明。日本政府は、北朝鮮が不具合の見つかったミサイルを発射台から撤去し、間を置かず予備のミサイルと入れ替えた可能性が高いとみている。

　こうした準備状況を把握するには米国の衛星情報が不可欠。だが、複数の政府高官によると、米政府はいったん撤去して以降の新たな情報は日本側に伝えるだけで韓国ルートは遮断したとされる。ある高官は「分別なく韓国から情報が漏れることに業を煮やし制裁を科した」と指摘する。

　発射が近いとの情報を踏まえ、野田佳彦首相は発射予告期間に入ってから３日目のこの日も午前７時前に官邸入り。８時から関係閣僚会議を開き、首相は「最高度の緊張感を持って現態勢を維持する」と警戒を継続するよう指示した。

　その場で「近日中の発射の可能性」に関する情報を共有し、午前１１時の藤村修官房長官の定例記者会見で国民に注意を国民に促すとの対処方針を立てていたが、北朝鮮がミサイルを発射したのは、この１時間余り後の９時４９分。

　政府高官の一人は「発射に向けた態勢の立て直しは予想を上回るスピードだった」と漏らす。結果的に、国民への情報発信という点で課題を残したことは間違いない。

　ただ、今年４月の前回発射（失敗）時は国民への情報公表が４０分以上も遅れたことに比べれば、今回の対応は「おおむね順調だった」（藤村氏）といえる。
