イスラエル・占領地域：
孤立化させられるガザ地区～人道危機にあるパレスチナの人びとのために～

＜背景情報＞
ガザ地区と西岸地区に住むパレスチナの人びとの生活状況は、日ごとに悪くなっています。イスラエルによってパレスチナ人の移動の自由は厳しく制限され、学校や職場、病院に行くことも困難な中、パレスチナ人の経済、文化、社会のあらゆる権利が侵されています。さらに、パレスチナの武装勢力同士の抗争が事態を悪化させています。
2005年11月15日、イスラエルとパレスチナ自治政府の間で、占領地域とガザ・エジプト国境への人と物資の移動を促すために「移動とアクセスに関する協定（ＡＭＡ）」が結ばれました。ＡＭＡは平和的な経済発展を促進し、パレスチナの人道状況の改善を目的としていました。しかし、実際には状況は改善されていません。
2006年、ガザとエジプトの国境と、貨物輸送のためのガザとイスラエル（カルニ）の検問所は長期にわたって閉鎖したままでした。ここ最近は以前ほど閉鎖されてはいませんが、深刻な状況が続いています。ラファの検問所はしばしば閉鎖し、ガザ地区に住む150万のパレスチナ人の移動が制限されています。検問所を通過することができても、帰りには閉鎖され、自宅に戻れないまま何日もエジプト側の国境で足止めされます。
物資を運び込むことができないため、生活に必要な製品が不足し物価は高騰しています。2007年に入っても、移動は厳しく制限されたままです。イスラエルとガザ地区を結ぶエレス検問所を通過できるのは外国人だけで、パレスチナ人が通ることはできません。またイスラエル当局は、ガザ地区～西岸地区をパレスチナ人や物資を乗せたバスやトラックなどが通過することを認めていません。

＜要請のポイント・抄訳＞
・ 国際人道法と人権法上の義務を守り、ガザ地区のパレスチナ人と物資の出入りを不必要、不適当で恣意的に制限することを止めること。特に、
・ ガザ地区内外への物資の通過に関するいかなる取り決めも、パレスチナ人の人権を尊重するものであることを保証すること。
・ 長期化している検問所の閉鎖を止め、集団的懲罰である人と物資の移動の制限すべてを解除すること。ガザとその他の占領地域のパレスチナ人が普通の生活を送れるよう、あらゆる努力をすること。
・ 出入りを規制する場合であっても、平等および比例の原則に基づくこと、また期限を定めること。
・ 何らかの制限を科す場合であっても、移動の自由を阻んだり、十分な水準で生活する権利を侵害したりしないよう保証すること。制限はまた、労働、教育、医療などに対するパレスチナ人の人権を侵害してはならない。

I am writing to you to express my deep concern about the humanitarian situation of Palestinians in the Gaza Strip.
I call on the Israeli authorities:
- To meet their obligations under international humanitarian and human rights law,
including by lifting the unnecessary, disproportionate and arbitrary restrictions currently placed on the movement of Palestinians and of goods in and out of the Gaza Strip.
Notably :
- To ensure that whatever arrangement is made for passage of goods in and out of the Gaza Strip it should be one that respects the human rights of the Palestinian population.
- To end the prolonged closures of the crossings for Palestinians and for merchandise in and out of the Gaza strip, lift all restrictions on the movement of persons and goods which constitute collective punishment and to make every effort to enable as normal a life as possible for the Palestinians in the Gaza Strip,
as well as in the rest of the Occupied Palestinian Territories.
- To ensure that no restrictions on the movement of Palestinians and goods are imposed unless they relate to a specific security threat, are non-discriminatory and proportionate in impact, and are of limited duration.
- To ensure that if restrictions are imposed they do not obstruct freedom of movement, or violate the right to an adequate standard of living - including adequate food, clothing and housing.
Restrictions also must not violate other human rights of Palestinians', including their right to work, to education and to the highest attainable standard of health.
