Gordon Brown bolsters civil liberty laws

Gordon Brown has promised to open a "new chapter" on civil liberty in Britain, signalling both tougher new anti-terrorism laws and stronger protections for individual freedoms.
新しいテロ防止法の厳格化と個人の自由の保護強化の両方をほのめかし、ゴードン・ブラウンはイギリスの市民自由に「新たな一章」を開くと約束した。

The Prime Minister's pledge came as his government published a wide-ranging package of constitutional reforms, returning key powers to parliament and announcing a review of state secrecy laws.
主要な権力を議会に戻し、国家秘密法改正を発表する広範な憲法改正包括案を政府が公表する中、首相は宣誓した。
"I want to explore how together we can write a new chapter in our country's story of liberty," Mr Brown said in a wide-ranging speech at the University of Westminster in London.

The government's approach to civil liberties will be about "renewing for our time our commitment to freedom and contributing to a new British constitutional settlement for our generation", he said.
政府の市民の自由に対する姿勢は「自由への我々の時代と我々のコミットメントを新たにし、我々の世代にとっての新しいイギリスの憲法的解決に貢献する」ものになるだろう、と彼は言った。
Ministers have already signalled that they want to revisit the potentially explosive issue of detention without charge for people suspected of terrorism.
テロ容疑者に対する告訴なしの拘留という潜在的に危険な問題を再び取り上げたい、と閣僚等は既にほのめかしている。
Police chiefs have said the current time-limit of 28 days is too low, though civil rights groups and many Labour MPs reject any extension. Mr Brown did not back away from suggestions of a higher limit today.

But he made clear that any extension would have to be accompanied by more legal protections for those detained.

"It is central to our tradition of civil liberties that no one should be held arbitrarily, and it is right that the longer someone is detained, the more concerns there are about arbitrary treatment," Mr Brown said.
「何者も独断的に拘留されてはならない、ということが我々の市民の自由の伝統の中心であり、拘留が長引くほど独断的対応についての懸念が増える、というのは正しい」

"Weighing that case for an extension of days against legitimate concerns about arbitrary treatment, I know the importance of making sure that whatever specific changes are agreed for special, perhaps exceptional, circumstances that might arise, there will be - and must be - greater protections for the individual - both greater legal or judicial safeguards on executive decisions and more intensive scrutiny of them by Parliament."

Earlier in the Commons, Jack Straw, the Justice Secretary, confirmed that the government will give the power to declare war back to Parliament.

In a broad package of constitutional reforms, he also promised to publish an annual government "security strategy" detailing terrorist threats and security measures.

Mr Straw also announced a consultation on the case for a new "British Bill of Rights and Duties".

Liberty, the civil rights campaign welcomed "a change in tone" from Mr Brown compared the rhetoric adopted by Tony Blair.

But the group said it was disappointed that the Prime Minister had not dropped plans for longer pre-charge detention and a national identity card scheme.
しかし同団体は、首相がより長期の告訴前拘留と国民IDカード計画を廃棄しなかったことには失望したと述べた。
