一国の政はなお一身の治のごとし、治まるゆえんを知らず
これは古代中国の古典にある言葉である。「政治は人間の健康と同じで、あれこれ策を弄せず、自然に治まっているのが最上である」という考えを主張したものである。
現在、政治の手法として規則や法を用いているが、上記の古典の考えでは、最上の政治手法ではないとしている訳である。
今の時代は、法治主義が至上であり、社会をよりよくするためには、法をより詳細に改善するのが正しいとされている。
確かに、治世のために法は有効な道具である。しかしながら、法はマイナスの側面をも持っていることを知らなければならない。
上記の言葉は、小国の使者が大国の王に語った言葉である。小国では、法が少なくても治まっても大国では法を整備しないと国が混乱するのは当然である。
しかし、法はその内容を誤れば逆に害をなすというマイナスの側面を持っていることに注意しなければならない。法の制定では、法の必要性、法の目的、法の受容性（受け入れやすいかどうか）、施策コスト、悪用の可能性等、多面的な考察が必要であり、こうした検証を踏まえた上で採否を決定するのが自然である。
私は、法は数が多いよりも洗練された少ない法で統治する方が良いと考えている。
法がないので取り締まれないというのは、法治が行き過ぎているからであり、法の抜け道を探して悪を行う輩を出さないという狙いもある。
現代社会は、法を重視するあまり、人間同士の血の通った信頼関係を軽視しているのではないか？
あるテレビの対談で、アメリカの弁護士の人数に比べて日本の弁護士の数が少ないと言う人物がいたが、弁護士の数などは少ない方が良いと思うが如何だろうか？
