The following is a paper by Shinoda Hideaki, an international political scientist, published in the monthly magazine WiLL, titled Constitutional Scholars Invaded by the Galapagos Constitution.
You are just reading this paper, Asahi Shimbun, Mainichi Shimbun, Tokyo Shimbun, Chunichi Shimbun, etc.
Those who subscribe to local newspapers that only post articles distributed by Kyodo News must immediately stop subscribing to those newspapers and pay 916 yen to subscribe to monthly magazines such as Will Everyone will feel keen.
Toshiyoshi Miyazawa, Yasuo Hasebe, Kenji Ishikawa, Souta Kimura ... Why are the professors of the Faculty of Law at the University of Tokyo soaked in a special ideology?
The constitutional scholar who is addicted to ideology
―Japan has been invited to participate in the ’voluntary association’ by the United States. More than 70 years have passed since the end of the war; there are a certain number of constitutional scholars who value the “Galapagos Constitutional Theory” pointed out by Dr. Shinoda in “Constitutional Diseases” (Shincho Shinsho).
Shinoda
Dispatching the Self-Defense Forces to the Holmes Strait is a policy theory that should be discussed there.
Revisions can be made only when necessary, but there are various policy-theoretic options, and policy discussions are needed regarding the timing of the review or how to diverge from the voluntary coalition framework.
However, what should not be done is to bring it into the constitutional theory and discuss the pros and cons of dispatching.
In the first place, it cannot be said that the Constitution prohibits the Self-Defense Forces from dispatching the Holmes Strait.
It is absolutely necessary to prevent the policy theory from being forcibly twisted by constitutional distortions by specific social forces.
I call the culture of a specific social group that claims a constitutional interpretation that follows a different ideological direction in a logical structure that is only valid in Japan and is called the Galapagos Constitutional Theory.
The 'Galapagos Constitutional Theory' is not supported by a precise interpretation of the Constitution, but 'Prevent the revival of militarism' 'Constitutionalism restricts power' It's just a fluffy abstract opinion like 'An Abe administration is running on the road that came someday 'or an ideological 'political gossip.'
Supporting this position is not the sophistication of constitutional interpretation, but the network of social groups connected by ideology.
