　I had the constructive IATA Legal Forum/24 at Washington D.C. and returned back to Tokyo last evening.

　　　　　

　IATA法律会議で数年ぶりにワシントンDCに行ってまいりました。

　　　　　　　　　　

　各国消費保護法制やEU一般データ保護規則（GDPR）の最新動向、Brexitやトランプ政権が航空運送実務に与える影響などが議論されました。

新年の海外出張報告（SFO/FRA/LON）

　I went to San Francisco to attend the oral argument at the 9th. Circuit Court on last Friday. The Courtroom One was majestic!
　It was a bullet business trip as usual, 1 night and 4days. NH150 from LAX to HND was the BB-8, STAR WARS JET.

　1/13に第9巡回裁判所（高裁に相当）弁論期日のため、サンフランシスコへ。例の大統領令を審査した裁判所です。
　第1号法廷は、なかなかに厳かな雰囲気でした。

　　　　　

　このときは特に成田→サンフランシスコ→ロサンゼルス→羽田の1泊4日の弾丸出張でした。

　I went on a business trip to Frankfurt and London for 4 days and 2 nights.
　We made the compliance training regarding competition law and FCPA. Through the training, you could know the fact that you can protect　yourselves and your company from the serious risk of violating law by understanding and practicing "Do’s and Don’ts".

　1/31・2/01には、コンプライアンスセミナーのため、2泊4日でフランクフルトとロンドンに行ってきました。
　いつも乗継ぎばかりだったので、フランクフルトの街に出るのは久しぶり。旧オペラ座のレストランでの会食も楽しめました。

　　　　　

　ロンドンは、ビックベンもガーキンも見えないハマースミス（東京でいえば、神田？蒲田？）。
　セミナーは実務に即した具体的な内容で、参加者の皆さんからは大変好評だったと思います。

　　　　

HKG, MUN, PAR, LON

I attended the IATA Legal Conference at Hong Kong. At the conference, I gave a report of the current states of a new legislation in the Japanese aviation law.

　　　　　

After that we made 10 successful presentations to the 37 underwriters at Munich, Paris and London for a renewal of the aviation insurance policy. However, I think there is a possibility that the market trend seems to be getting hard.

　　　　　

WTW Aviation Conference, SIN

　I had a constructive conference held on 8–11 March at Singapore, and returned back to Tokyo yesterday. Topics for discussion in the conference are not only aviation insurance but also reputation risk and safety culture.

　　　

　保険関係の会議に出席するため、シンガポールへ。多くの保険引受人（underwriters）とも会談ができ、有意義な出張となりました。

IATA Legal Forum, Barcelona

　In the IATA Legal Forum/22 at Barcelona Spain, 17 Feb. I explained the outlines of a new Legislation in the Japanese Aviation Law.
　As you may know, Japanese law on transportation in Commercial Code 1899 has no reference to aviation now.Currently, the airline’s Conditions of Carriage applies only to domestic air transportation in Japan.
　Under the situation, the Legislative Council of the Ministry of Justice discussed the new legislation on the Japanese Aviation Law for two years（I'm a member of the Council）.
　Most rules in the draft are similar to Montreal Convention and the Conditions of Carriages. For example, any provision to relieve a carrier of liability, regarding compensation in case of death or injury of passengers, shall be null and void. Therefore, the new Japanese law will have a very small influence, if any, on the current aviation practice.
　The new rules are expected to come into effect in 2017.

　2月16～19日の間、スペイン・バルセロナにて開催された国際航空運送協会（IATA）の法律会議とStar Alianceのlegal conferenceに参加し、日本の運送法改正の最新状況について報告してきました。

　会議の合間にバルセロナの旧市街やサグラダファミリアを散策することもできました。

IATA Legal Forum 2015

　2月24～26日の間、ソウルにて開催された国際航空運送協会（IATA）の法律会議とStar Alianceのlegal conferenceに参加しました。

　滞在先で食中毒に罹ったらしく、体調不全の出張でしたが、なんとか打合せなどはこなして、昨日帰国。一日休養し、火曜からの香港の保険会議に備えたいと思います。

S.F.出張

　8/15にサンフランシスコ北部地裁で係属中の米国裁判（class action）の期日（summary judgment hearing）が入ったため、現地に出張してきました。サンフランシスコは、今年2月の会議以来です。

　前日8/14、成田からSFOに直行し、午後から弁護士事務所で打ち合わせ、翌日に備えました。

　打合せの後は、"BLUE STEM"にて会食。特に肉料理が美味でした。

　宿は2月時と同じく、"Hilton S.F. Union Suare"。成田出発から太平洋を越えて、不眠不休。長い一日でした。


　翌8/15、サンフランシスコ北部地裁へ。

　　　

　本件の担当判事はJudge Charles Breyer（最高裁判事Judge Stephen Breyerの実弟）、6号法廷での審理でした。
　なかなかに手際のよい訴訟指揮だと思いました。Judge Breyerの判断は約1か月後に下されるとのこと。

　　　　　　　　　　

Doposition

　係属中の米国集団訴訟（class action）の証言録取手続き（deposition）を支援するため、12/30（月）から1月4日（土）の間に出張し、ニューヨークで年を越します。帰国は、新年1月5日（日）の予定です。

　クラスアクションとは、民事訴訟の一種で集団訴訟に関する手続きのことをいい、日本の現行法にはない訴訟形態です。個々の利益帰属主体が個々に訴訟手続きをしなくても、その代表者による訴訟を提起し、消費者の権利を一括して行使する権限が認められます。
　ちなみに、消費者庁は、法案提出を準備している集団的消費者被害回復にかかる訴訟制度（日本版クラスアクション）の法案提出を準備しています。しかし、企業法務の立場から、米国の状況をみれば、悪用・濫用の現実も否定することはできず、この制度には大きな問題があると実感しています。この点、経団連や米国商工会議所も反対する立場を表明しているようです（日本における集団訴訟制度に関する緊急提言）。

　また、証言録取（deposition）とは、米国独特のディスカバリー（証拠開示）制度のひとつで、法廷外で証人が自分の知識・経験や考えなどを供述し、それを記録に取る手続きです。

　今回の出張では、期間中のほとんどを現地の法律事務所での打合せに費やしますが、大晦日の夜だけは、米国弁護士たちとEleven Madison Park RestaurantでNew Year's Eve Dinnerを楽しむ予定です。

国際法務入門　第31回
　類義語の重複

　英文契約書では、同義語・類義語を重複して使用する例が多い。以下は、その例である。

・authorize and direct（授権する）

・covenant and agree（合意する）

・each and all（すべての）

・final and conclusive（最終の）

・from and after（～以降）

・made and entered into（作成・調印した）

・null and void（無効の）

　英文契約書を読解・審査（review）するに際しては、こうした重複使用に慣れるしかないが、一方で、自らが契約文を起案（draft）する場合には、なるべく重複使用を避けた分かりやすい英語（plain English）に心がけるべきであろう。

　古語・ラテン語の多用

　英文契約書には、古語やラテン語が多く使用されている。たとえば、前文に用いられている”whereas”などは、現在は使われない古い英単語である。

　また、契約書に頻出するラテン語には、次のようなものがある。

・bona fide（善意の、真実の）

・in re（～に関する）

・prima facie（一応の）

・pro rata（按分に、比例して）
