■The Constitutional Court of Korea who dismissed President on 10th March 2017 for the first time in Korean history by ruling that the impeachment and prosecution by the National Assembly against President Park was constitutional is "the independent genuine constitutional guard"!
The Korean Constitutional Court has seen whether President Park had committed the following five state power crimes on the case of the intervention in the government by Choi Seung-sil, a close friend of President Park, which was the basis of the impeachment and prosecution by the National Assembly.
No1. if President Park has violated public sovereignty and law-doctrine or not?
No2. if President Park has abused presidential authority or not?
No3. if President Park has done media repression or not?
No4. if President Park has violated the civil protection obligation in the case of the sinking accident of the passenger ship Seol in 2014 or not?
No5. if President Park has conducted illegal activities such as bribery etc or not?
All eight judges of the Korean Constitutional Court recognized that President Park was guilty in the 4 state power crimes charges except No.4 saying that "the unconstitutional and illegal acts and negative influence and ripple effect given to the constitutional order are serious" and that the dismissal was reasonable".
This proved that Korea has "independent genuine Constitutional guard".
As in Korea,in Germany, France, Italy, Austria and Spain where the Constitutional Court "Independent genuine Constitutional guard" exists,if the highest leader of the country like President Park in Korea has committed the state power crime, the people, the media and the Diet would not allow it and they would act critically.
And the National Assembly resolves to impeachment, and finally the Constitutional Court will make a final decision and dismiss it.
And if the National Assembly resolves to impeachment and prosecution, the Constitutional Court will make a final decision and dismiss them.
However, in Japan and in the United States where there is no "genuine independent constitutional guard" but there is only the "fake constitutional guards = Supreme Court", the supreme leader such as Prime Minister of Japan and President of US will never be dismissed nor
punished by anyone.
The eldest Prime Ministers of Japan, such as Shigeru Yoshida, Nobusuke Kishi,Eisaku Sato,Yasuhiro Nakasone and Junichiro Koizumi and the current Prime Minister Shinzo Abe are never dismissed and the state power crimes which they have committed are never punished.
The past US presidents such as Johnson, Nixon(resigned), Reagan and Bush (father), Clinton, Bush (son), Obama have never been dismissed and the current Trump will never be dismissed.
Even if they repeated dozens and hundreds of state power crimes, no one could not dismiss them and no one could not punish their state power crimes!
Because in Japan and in the United States, there is the Supreme Court who camouflage the "Constitutional Guardian" instead of the Constitutional Court,"the genuine independent constitutional guardian".
The Supreme Court of Japan and the United States have kept silence,accepted and cooperated in the back with the successive Prime Ministers and the President by ignoring,violating and destroying the Constitution with the face of the guardian of the constitutionalismm and legalism.
"The revolutionary citizens" in Japan and in the United States must learn from "Korean Democratization Struggle" in 1987 when the Korean people rallied and won the establishment of the Constitutional Court from President Doo Hwan.
"The revolutionary citizens" in Japan and in the United States must settle for a democratization struggle 30 years later and we must dismantle the Supreme Court and create the independent Constitutional Court!
