６．９のブログで「文書作成、真っ白でーす」と書いた。６．２０付文書を作成した。
７．７のブログで「説得的書面作成は難しい」と、
７．１４のブログで「一日中家に閉じこもり、作業に集中」と書いた。７．１７付文書を作成した。
緊急事態宣言解除後最初の期日７．３０に正式に提出となる。
それに対する相手方の反論の書面が８．２７の期日に正式提出される。１週間前に送られてくるので、内容は事前に分かっている。
あまりにも無責任、いい加減な書面だった。
裁判の期日というのは、大抵は、書面の提出を確認し、次回までに相手方が反論することを確認するだけ。
原告であるにもかかわらず、言いたいことだけを言うだけで、嘘の言いたい放題、いい加減な証拠を出すだけ。不利なことはハグラカし。
裁判官を納得させるために、前記の通り苦労したわけである。
８．２７期日は、入念に準備した。
レジュメを作成することにしている。会議資料のようなきちんとしたものである。
頭の中を見える化するものと位置付けている。手間暇かかるが、準備万端で臨むと、裁判官に与える信頼感が抜群に違うのが肌でわかる。
どうやら、裁判官は、かなり、理解が進んでいたようで、同じ認識のようだった。
裁判官も準備をして臨んでいることが分かった。
ということで、相手方で何をすべきかを、議論して決めた。所要時間約５０分。ちょっと珍しい。
事案が複雑になってくると書面だけでは理解は不十分で、対面で、証拠や書面を見ながらの議論が絶対に不可欠だ。いかに準備して臨んでも、議論を通じて学ぶこと、気づくことが必ずある。事件に対する理解がさらに深まる。自信につながる。
コロナでテレワークが新常態になりつつあるが、オフィスワークは絶対になくならないのと同じようなもの。
裁判は原告が訴訟を提起して始まる。
原告が嘘をついていたとしても、そういうことはわからないので、原告の土俵で戦うことになる。
それでは、被告は勝てない。
議論の場を被告の土俵に移して戦うことである。
土俵を移すことは、そう簡単にはいかない。人間というのは、バイアスがあるからである。

アメリカやヨーロッパでは、早くからMOOCｓ（ムークス）というインターネットで無料で学べる環境があった。無料なので、時々、気軽に聞いていたことがあった。
「The game of framing and reframing」というのがあった。
その最初の基本原則はつぎのようなもの。
The victim/villain/hero model is the first model in the game of framing and reframing.
Many frames are based on this model.
In conclusion, you should never step into a frame in which you are the villain.
If your opponent is framing you as the villain, your best option is to reframe the debate
by presenting a different version of the same reality and changing the roles so that you
become the hero.
Will you win if you do this?
Not necessarily, whether you win or lose depends upon the opinion of the listeners.
But at least you have made clear that there are different perspectives on this problem,
and that there are no unambiguous victims, villains and heroes.
