"Israel is a state of law"? Stop joking...(Nov 10, 2014)

今回は小ネタ。


2008年のことになるが、イスラエルで「国家転覆を呼び掛けた」人に対し市民権を剥奪するための法案が議会に提出→否決された。
で、つい先日、ベンヤミン・ネタニヤフ(Benyamin Netanyahu:בנימין "ביבי" נתניהו)イスラエル首相がこれを再び議会に提出すと言いだしたのだが・・・。

色んな意味で危険なにほひしかしないこの話。

Netanyahu made the announcement after declaring earlier Saturday that he would increase measures to stop the ongoing cycle of violence in Jerusalem, Judea and Samaria after multiple attacks.

"Israel is a state of law," he said.
"We will not tolerate disturbances and riots. We will act against rock throwers, road blockers and those calling for the establishment of a Palestinian state in place of Israel. Those who do not respect Israeli law will be punished very seriously."

If passed, the law could become the most stringent application of revoking citizenship in the Western world - i.e. revocation based on comments alone instead of actions.

Many countries do not allow revoking citizenship for any reason, including the US, Canada, Scandinavia. Other countries - such as Greece, the UK, and Australia - only give the authorities the power to do so only in severe cases, e.g. treason or involvement in terror groups abroad.

Recent efforts to revoke citizenship have primarily revolved around enlistment to terror groups.
In December, worldwide hysteria over a growing number of radical Muslims from the West joining the group culminated in the quiet revocation of UK citizenship of British Islamists found to be fighting with the group; and just last month, a similar motion was presented to Netanyahu for Israeli Arabs by Tourism Minister Uzi Landau.

That motion was filed after thirty Israeli Arabs were revealed to have joined ISIS as of last month, and after a slew of incidents involving incitement against Israel or participation in Arab rioting since unrest erupted in June.

そもそも、何をもって「国家転覆を呼び掛けた」と判断するんだか。
Netanyahu首相のコメントを馬鹿正直に信じるなら、この数日エルサレム(アル・クッズ)で起きてる抗議デモへの参加呼びかけだって「国家転覆」と判断される余地があるわけで。
要は、今回の動きってのは、イスラエル政府が一連の抗議デモというかパレスチナの人達を危険視してることの裏返しとも言える。
無論、この法案が成立した後では、ユダヤ系の人達による(イスラエル政府への)抗議デモへの参加呼びかけも「国家転覆」の判断対象になりうるが・・・。


というか、イスラエルで市民権が剥奪されたのは過去に2人しかいないんだよな。

この辺に関して、イスラエル市民権協会(ACRI)は、今年4月にイェフダ・ワインスタイン(Yehuda Weinstein:יהודה וינשטיין)司法長官に対しイスラエルに収監されている(イスラエルの市民権を持ってる)パレスチナの囚人の市民権剥奪を中止するよう求めた書簡(Adalahと合同で提出)の中で、意味深な指摘をしていた。

The Association for Civil Rights in Israel and Adalah – The Legal Center for Arab Minority Rights in Israel sent a letter today to Attorney-General Yehuda Weinstein, to demand that he refrain from approving an initiative to revoke the citizenship of Arab-Israeli security prisoners.
The letter was sent following recent reports of attempts to revoke the citizenship of 14 prisoners who are due to be released from prison in the framework of the negotiations between Israel and the Palestinian Authority.

Adalah Attorney Hassan Jabareen and ACRI Attorney Oded Feller emphasized in the letter that the Supreme Court has previously denied similar attempts at revoking citizenship, even when in relation to extremely serious crimes.
In 1996 the Supreme Court rejected a petition to revoke the citizenship of Yigal Amir, who assassinated Israeli Prime Minister Yitzhak Rabin, on the grounds that civilized society expresses its disapproval of the murder in other ways, not through the revocation of citizenship, which is one of the most basic fundamental rights.

Attorney-General Weinstein’s predecessor – Attorney-General Mani Mazuz – stated his opinion that the authority to revoke citizenship as a result of a “breach of trust” is an extraordinary power that does not exist in most countries.

According to the joint letter – the revoking of citizenship is an extreme power characteristic of totalitarian regimes.
For instance, Soviet law allowed the revocation of citizenship based on “breach of trust”.
Former soviet countries made frequent use of this ability to expel disinherited citizens to remote regions.
The right to citizenship is a fundamental right recognized in the Universal Declaration of Human Rights 1948, and has been entrenched over the years in a number of complementary international commitments.

According to ACRI Attorney Oded Feller: “In all of Israeli history, only two citizens have had their citizenship revoked on the basis of “breach of trust”, and it is not surprising that both of these were Arab citizens. In this case before us, the use of such extraordinary powers sends a discriminatory and humiliating message to all Arab citizens of Israel that their citizenship is in question.”

イスラエル政府にしてみれば、「ユダヤ国家」を掲げる以上ユダヤ系の人達の市民権剥奪はなんとしてでも避けたいのが本音とはいえ。
この法案が実際に成立すれば、適用対象がパレスチナの人達「だけ」じゃなくなるのは時間の問題なんだろうな。
ってのを踏まえると、例の法案に関してもっと批判がなされるべきはずなのに・・・。


というか。

この法案について、内心では同じことをやりたいと考える国は西側諸国にも意外とあるかもしれん(汗)。
