Welcome to issues in Japan.


This time I would like tentatively to share some of the insights of Mr. Takahiko Ohta, Senior Research Fellow at the Nakasone Peace Institute.

His theme is:
Regulatory trends and practical responses to real estate transactions in the U.S. and Japan from the perspective of National Security.

Legislation regulating inward direct investment, such as corporate acquisitions, from the perspective of national security has existed in the United States and Japan for some time, but it did not explicitly target real estate transactions.

In recent years, however, regulations that explicitly target real estate transactions have been introduced from the perspective of security.

In the United States, the Foreign Investment Risk Review Modernization Act (FIRRMA), enacted in August 2018, added real estate transactions as a subject of review by the Committee on Foreign Investment in the United States (CFIUS).

In Japan, the Law Concerning the Survey of Land Use and Regulation of Land Use around Important Facilities and in Remote Islands, which was enacted in June 2021, has introduced regulations on real estate transactions from the perspective of security.
