Former EY partner convicted over film tax scam

英EYの元パートナーが、映画への投資を優遇する制度を悪用した脱税スキームを作って、税務当局をだましていたとして、有罪判決を受けたという記事。

A former EY partner and a financial adviser have been convicted of conspiring to cheat HMRC out of tax by creating a tax evasion scheme

Terence Potter, a former partner at EY and former chairman of the South Wales branch of the Chartered Institute of Taxation, designed the scheme, which aimed to exploit a tax loophole by investing in film finance, according to a report in The Times.

この元パートナーは、Aquarius Filmsという会社を設立し、映画製作への投資資金を集めていました。映画産業への投資促進のため、政府は、会社の損失に対し、40％の税控除を提供していましたが、その際に、投資者が毎週10時間超、そのプロジェクトに従事することが条件となっていました。

Potter set up a company called Aquarius Films to produce investment for a film. At the time, the government was offering tax relief of 40% on any losses the companies made to encourage investment in the film industry. In order to qualify for uncapped relief, investors had to prove they had worked for 10 hours or more on the project each week.

すでに、3人のトレーダーが、このスキームに関与して禁固刑を受けています。 Starsuckersというドキュメンタリー映画の製作に従事したと装って、60万ポンド超の脱税を行ったとされています。彼らは、週10時間という条件を満たしているという書類を偽造して提出していました。

Three former City traders have been jailed for their involvement in the scheme. James Hyde, Philip Jenkins and Hamish Maclellan who worked for US investment bank Bear Stearns, before moving to Jefferies International, were convicted of conspiring to cheat HMRC of more than £600,000 in tax by pretending to be actively involved in creating Starsuckers, a 2009 documentary. HMRC alleged that the men conspired to present false documents showing they had met the 10-hour weekly time target. They have each been jailed for four and a half years.

EYの元パートナーは、Starsuckersの脱税スキームのほか、Mercedesという製作されなかった映画のスキームへの関与で、有罪となりました。

Potter was convicted of conspiring to cheat the Revenue in the Starsuckers scheme and also pleaded guilty in the Mercedes trial, the report added.

大手事務所からの転進が、脱線してしまったようです。
