An Olympics not to remember

オーストラリアに本拠を置く資源大手のBHP Billiton社が、北京オリンピックで外国政府の官僚らを接待したことに関連して、25百万ドルの和解金を支払うことになったという記事。

FTSE 100 heavyweight BHP Billiton has paid out $25m (£16m) to settle a charge relating to its sponsorship of foreign government officials at the Beijing Olympics

BHP Billitonは、おもにアフリカとアジアの公務員や政府所有企業の従業員176人を、北京オリンピックに、費用会社負担で招待したことにより、連邦海外腐敗行為防止法（ＦＣＰＡ）違反を問われました。

The Australian-based global resources group had run up against the Foreign Corrupt Practices Act (FCPA) when it invited 176 government officials and employees of state-owned enterprises, primarily from Africa and Asia, to attend the Games at its expense.

176人のうち最終的に60人（一部は配偶者などを連れて）が招待に応じ、高級ホテルでの宿泊や観光旅行を含む3～4日のホスピタリティ・パッケージを楽しみました。その費用は1件当たり12千ドルから16千ドルにもなりました。

Ultimately, 60 guests accepted, in some cases with spouses and others, and enjoyed three or four-day hospitality packages that included event tickets, luxury hotel accommodation and sight-seeing excursions, valued at $12,000 to $16,000 per package.

米SECの担当ディレクターは、同社は、政府公務員をオリンピックに招待することが、腐敗行為防止法違反の高いリスクをもたらすことを認識していながら、そのリスクに対処する十分な内部統制を適用しなかったと指摘しました。

Andrew Ceresney, director of the enforcement division of the US Securities and Exchange Commission, which brought the charge, explained that Billiton had footed the bill for the government officials while they were “in a position to help the company with its business or regulatory endeavours”.

“BHP Billiton recognised that inviting government officials to the Olympics created a heightened risk of violating anti-corruption laws,” he said, “yet the company failed to implement sufficient internal controls to address that heightened risk.”
