(IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq.), and section 301 of title 3, United States Code, I hereby report that I have issued an Executive Order declaring a national emergency to deal with the threat posed by the People’s Republic of China’s (PRC) increasing exploitation of United States capital to resource and to enable the development and modernization of its military, intelligence, and other security apparatuses which continues to allow the PRC to directly threaten the United States homeland and United States forces overseas, including by developing and deploying weapons of mass destruction, advanced conventional weapons, and malicious cyber-enabled actions against the United States and its people.

Through the national strategy of Military-Civil Fusion, the PRC increases the size of the country’s military-industrial complex by compelling civilian Chinese companies to support its military and intelligence activities. Those companies, though remaining ostensibly private and civilian, directly support the PRC’s military, intelligence, and security apparatuses and aid in their development and modernization. At the same time, they raise capital by selling securities to United States investors that trade on public exchanges both here and abroad, lobbying United States index providers and funds to include these securities in market offerings, and engaging in other acts to ensure access to United States capital. In that way, the PRC exploits United States investors to finance the development and modernization of its military.

The Executive Order prohibits certain purchases involving publicly traded securities, or any securities that are derivative of, or are designed to provide investment exposure to such securities, of any Communist Chinese military company. Those companies are ones the Department of Defense has listed, or will list, pursuant to section 1237 of Public Law 105-261, as amended, or are identified as Communist Chinese military companies or their subsidiaries by the Secretary of the Treasury using similar criteria. The Executive Order also prohibits transactions that evade or avoid, or have the purpose of evading or avoiding, its prohibitions.

1. Japan is seriously concerned about the decision made by China’s National People’s Congress regarding policies toward Hong Kong Special Administrative Region in the midst of strong concerns expressed from the international community and the people of Hong Kong and about the situation concerned in Hong Kong.

2. Hong Kong is an extremely important partner for Japan with which Japan maintains close economic ties and people-to-people exchanges. It is the long-standing policy of Japan to attach great importance to upholding a free and open system which Hong Kong has been enjoying and the democratic and stable development of Hong Kong under the ‘One Country Two System’ framework. 

3. Japan has conveyed such views to China and will continue to carefully observe developments surrounding Hong Kong. Japan will cooperate with other countries and address the situation in an appropriate manner.

1　5月28日,秋葉剛男外務事務次官は,孔鉉佑 ( こう・げんゆう ) 駐日中国特命全権大使を召致し,以下を申し入れました。

( 1 ) 我が国は,今般,全国人民代表大会において,香港特別行政区に関する議決が,国際社会や香港市民が強く懸念する中でなされたこと及びそれに関連する香港の情勢を深く憂慮していること。
( 2 ) 香港は,我が国にとって緊密な経済関係及び人的交流を有する極めて重要なパートナーであり,「一国二制度」の下に,従来の自由で開かれた体制が維持され,民主的,安定的に発展していくことが重要であるというのが我が国の一貫した方針であること。

Statement from UK Foreign Secretary Dominic Raab, Australian Foreign Minister Marise Payne, Canadian Foreign Minister François-Philippe Champagne, and US Secretary of State Michael Pompeo:

Signatories to this statement reiterate our deep concern regarding Beijing’s decision to impose a national security law in Hong Kong.

Hong Kong has flourished as a bastion of freedom. The international community has a significant and long-standing stake in Hong Kong’s prosperity and stability. Direct imposition of national security legislation on Hong Kong by the Beijing authorities, rather than through Hong Kong’s own institutions as provided for under Article 23 of the Basic Law, would curtail the Hong Kong people’s liberties, and in doing so, dramatically erode Hong Kong’s autonomy and the system that made it so prosperous.

China’s decision to impose the new national security law on Hong Kong lies in direct conflict with its international obligations under the principles of the legally-binding, UN-registered Sino-British Joint Declaration. The proposed law would undermine the One Country, Two Systems framework. It also raises the prospect of prosecution in Hong Kong for political crimes, and undermines existing commitments to protect the rights of Hong Kong people – including those set out in the International

Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights.
We are also extremely concerned that this action will exacerbate the existing deep divisions in Hong Kong society; the law does nothing to build mutual understanding and foster reconciliation within Hong Kong.

Rebuilding trust across Hong Kong society by allowing the people of Hong Kong to enjoy the rights and freedoms they were promised can be the only way back from the tensions and unrest that the territory has seen over the last year.

The world’s focus on a global pandemic requires enhanced trust in governments and international cooperation. Beijing’s unprecedented move risks having the opposite effect.

As Hong Kong’s stability and prosperity are jeopardised by the new imposition, we call on the Government of China to work with the Hong Kong SAR Government and the people of Hong Kong to find a mutually acceptable accommodation that will honour China’s international obligations under the UN-filed Sino-British Joint Declaration.
